EA's Origin Service Is Basically Spyware, According to Origin's EULA

Agreeing to Origin's TOS effectively gives EA permission to track all manner of bizarre information about your computing habits, and sell them to third parties.

Because today's trifecta of corporate malfeasance and/or generally shitty behavior wouldn't be complete without mentioning something awful EA is doing, let's talk about Origin again. Specifically, how it apparently includes spyware.

Once again reminding us all that we really ought to be reading these terms of service that we so often blindly agree to, intrepid users of Origin have discovered within EA's End User License Agreement for the service that, by installing the software on the system and using it, you are giving EA full license to track a number of different things on your computer, including, but not limited to personal information, computer information, application usage, software, software usage, and peripheral hardware usage. The reason for all of this is for the usual "marketing purposes" and "to improve our products and services" nonsense, but the EULA also states that EA will happily sell your information to any third parties it sees fit.

It's fair to point out that Valve's Steam service also does some of the things listed here when you use it. However, the trick is that Steam allows users to opt out of any and all such practices. Origin has no such opt-out feature, and in fact states that you cannot use the service at all unless you agree to their terms.

That does present quite the quandary for the information protective gamers out there who might want to play a game like, say, Battlefield 3 on their PC. Battlefield 3, alongside other EA PC titles, will require an install of Origin to operate, even if you buy a physical copy of the game.

In the end, this is actually a fairly fixable problem for EA. The publisher would simply need to patch in an opt-out option for any and all info scraping that Origin might be involved in. If it doesn't? Here's a deeply enraged Reddit thread that you might want to partake of.

@Oddsor: Take it you are planning on moving away from PC gaming in the future.  Because I think Steam & Steam like platforms are basically the future for PC gaming, especially with the increasing lack of shelf space in stores for PC games.
 
I'll always love Paradox Interactive's DRM policy.  You need to register a code on their forum to get access to the support forum for patches & anything like that.  But otherwise you install it & you play it.  No need of a disc, no always-online restrictions, it's wonderful & painless.

that's pretty shitty of them. change it now ea. since they probably won't and i only use steam i guess it won't matter for me. my pc is pretty nice, but not battlefield 3 looking better than consoles nice. so it doesn't matter to me yet.

It's pretty dumb that EA won't just submit to steam, this shit is getting stupid. Get with it you dip shits, your slander on the COD franchise and this Origin garbage both come off as pretty unprofessional to me.

I was actually starting to like EA before all this crap, but hey, at least they're still a step up from Activision. I don't support Activision by buying their games, I dislike them that much.

How ironic that Brad was waxing poetic, at least in the hypothetical sense, on how he was excited to see where Origin would go, if it would be a true Steam competitor. It's not even in the same category as Steam. Go fuck yourself, EA. Surely there has to be a better way for you to make money.

You know I didn't mind the minor annoyance of having to have Origin going to play BF3, but this actually has me considering the console option. I just don't see how they can win when every move they make with this program seems to screw over the customer.

@Nettacki: The way I see it empirical data gathering isn't illegal. It isn't done to reveal you as a criminal or anything, stats can be useful for a lot of things. It can even help improve things for the consumer down the road.

Well use a full virtual machine or something like SandBoxee EA no longer gets access to your computer except for copies of the files it needs.  yeah it's a waste of HD space but blame EA for that.

People are making a huge deal out of this right now so hopefully my comments will put this into perspective.
 

The section in question:

You agree that EA may collect, use, store and transmit technical and related information that identifies your computer (including the Internet Protocol Address), operating system, Application usage (including but not limited to successful installation and/or removal), software, software usage and peripheral hardware, that may be gathered periodically to facilitate the provision of software updates, dynamically served content, product support and other services to you, including online services. 

All this means is that they can use the information they obtain to provide software updates, dynamic content, product support and online services like Battlefield 3 multiplayer for example. BFD.
 


EA may also use this information combined with personal information for marketing purposes and to improve our products and services. We may also share that data with our third party service providers in a form that does not personally identify you. IF YOU DO NOT WANT EA TO COLLECT, USE, STORE, TRANSMIT OR DISPLAY THE DATA DESCRIBED IN THIS SECTION, PLEASE DO NOT INSTALL OR USE THE APPLICATION.

 
This just means that they can  also use this information to help market their products and SHARE it with third party service providers like DICE without identifying your personal information so that means they can't give out your IP or your computer name or username or anything else that would identify you. It says absolutely nothing about selling this information.
 
This needs to be put into the proper perspective. Did we all lose our reading comprehension overnight? EA can look at whatever the hell they want on my computer as far as I am concerned as long as it is used in the above context. If it is not then they will be in breach of their own EULA and I'll sue their asses. Until then though, this is completely harmless and I would not encourage any of my fellow gamers to give into this fear mongering BS.

I never saw the word "sell" anywhere there, at least not in the context of personal information to third parties. I only saw "share," which is still pretty bad, but nothing that hasn't been done before by other companies.

incidentally we need an honest judge to crack down on EULAs - contracts no one actually signs or agrees to before a purchase should not be legal.  also their widespread use to push abusive terms onto the customer without compensating them or even showing a shred of intent to negotiate terms is pretty much the definition of an unenforceable (illegal) contract.

Since I still want to play BF3.

I will simply deny Origins internet access outside of the little time it needs to verify the game.

It still sucks and is distasteful, but hey one of the reasons to game on the PC at all is the ability to control your own operating environment.

You know, EA have the tools to collect empirical data, and they distribute that to companies who make use of those statistics for a fee. This is practiced by so many companies and have been for so long that this is only brought up because it happens to be EA this time.
