Microsoft Tries to Clear Up Xbox One's New Policies

New details on used games, game licensing, Kinect privacy concerns, and more.

Microsoft came under intense scrutiny regarding its DRM and always on policies for Xbox One after the initial hardware reveal, and just days ahead of its E3 press conference, the company has released new details about how it’ll all work.

There are still questions (ones that I’ll, sadly, be unable to ask since Microsoft cancelled my one-on-one interviews with its executives at the last second!), but here’s what we now know. These quotes come directly from Microsoft:

Always On

  • While a persistent connection is not required, Xbox One is designed to verify if system, application or game updates are needed and to see if you have acquired new games, or resold, traded in, or given your game to a friend. Games that are designed to take advantage of the cloud may require a connection.

  • With Xbox One you can game offline for up to 24 hours on your primary console, or one hour if you are logged on to a separate console accessing your library. Offline gaming is not possible after these prescribed times until you re-establish a connection, but you can still watch live TV and enjoy Blu-ray and DVD movies.

Used Games

  • Buy the way you want—disc or digital—on the same day: You’ll be able to buy disc-based games at traditional retailers or online through Xbox Live, on day of release. Discs will continue to be a great way to install your games quickly.
  • Access your entire games library from any Xbox One—no discs required:After signing in and installing, you can play any of your games from any Xbox One because a digital copy of your game is stored on your console and in the cloud. So, for example, while you are logged in at your friend’s house, you can play your games.
  • Share access to your games with everyone inside your home: Your friends and family, your guests and acquaintances get unlimited access to all of your games. Anyone can play your games on your console--regardless of whether you are logged in or their relationship to you.

  • Trade-in and resell your disc-based games: Today, some gamers choose to sell their old disc-based games back for cash and credit. We designed Xbox One so game publishers can enable you to trade in your games at participating retailers. Microsoft does not charge a platform fee to retailers, publishers, or consumers for enabling transfer of these games.
  • Give your family access to your entire games library anytime, anywhere:Xbox One will enable new forms of access for families. Up to ten members of your family can log in and play from your shared games library on any Xbox One. Just like today, a family member can play your copy of Forza Motorsport at a friend’s house. Only now, they will see not just Forza, but all of your shared games. You can always play your games, and any one of your family members can be playing from your shared library at a given time.
  • In our role as a game publisher, Microsoft Studios will enable you to give your games to friends or trade in your Xbox One games at participating retailers. Third party publishers may opt in or out of supporting game resale and may set up business terms or transfer fees with retailers. Microsoft does not receive any compensation as part of this. In addition, third party publishers can enable you to give games to friends. Loaning or renting games won’t be available at launch, but we are exploring the possibilities with our partners.
  • Give your games to friends: Xbox One is designed so game publishers can enable you to give your disc-based games to your friends. There are no fees charged as part of these transfers. There are two requirements: you can only give them to people who have been on your friends list for at least 30 days and each game can only be given once.

Kinect Privacy

  • You are in control of what Kinect can see and hear: By design, you will determine how responsive and personalized your Xbox One is to you and your family during setup. The system will navigate you through key privacy options, like automatic or manual sign in, privacy settings, and clear notifications about how data is used. When Xbox One is on and you’re simply having a conversation in your living room, your conversation is not being recorded or uploaded.

  • You are in control of when Kinect sensing is On, Off or Paused: If you don’t want the Kinect sensor on while playing games or enjoying your entertainment, you can pause Kinect. To turn off your Xbox One, just say “Xbox Off.” When the system is off, it’s only listening for the single voice command -- “Xbox On,” and you can even turn that feature off too. Some apps and games may require Kinect functionality to operate, so you’ll need to turn it back on for these experiences.

  • You are in control of your personal data: You can play games or enjoy applications that use data, such as videos, photos, facial expressions, heart rate and more, but this data will not leave your Xbox One without your explicit permission. Here are a few examples of potential future scenarios:

    • A fitness game could measure heart rate data to provide you with improved feedback on your workout, allow you to track your progress, or even measure calories burned.

    • A card game could allow you to bluff your virtual opponent using your facial expressions.

@mrfluke: I explained my situation and how this news will affect me and then made a general statement not directed at anyone.

I would like it if people wouldn't comment about un-realistic scenarios in a pessimistic light. I would like to see them explain if these hindrances are actually issues for them. The rampant hatred seems unrealistic to me.

I'm not saying everyone is doing this, but if you read any comment thread on game sites about this news you will rarely hear people mention how it will affect them and just hear them complain about restrictions in a vague and general manner or give some worst-case scenario.

XB One is dead on arrival. Got it. The lack of peer to peer sales and game rentals will make me vote with my dollars and not buy this console (or a PS4 if they have the same restrictions). The greed of publishers will kill the game console model.

I no longer see a video game console I want to play. This makes me very sad. The restrictions put in front of the consumer are complicated and I can't imagine non-tech people being able to understand this easily. Plus, what the hell are our service men and women going to do? These restrictions make it very hard on them as well.

Something else I thought of: hackers and crackers are going to LOVE the Xbox One. These people thrive on trying to break systems and I'm sure that they cannot wait to dig into this box and have their way with it.

Fuck, I can't even understand it because the wording is sleazy and all shit. Does "giving" refer to lending or selling, or are they considered the same thing and thus you can only give a game to a friend and then you no longer own it, regardless if the intention was to lend him the game or sell it to him? How does the 10 Family Members work? Is there a parent account and then sub-accounts? Can all 10 family members on 10 different Xbox One's access the Shared Library at once, granted they are all playing different games, or can only one person access the Shared Library at once? What happens if my console breaks or is stolen? How do I do a license transfer to a new console so I can access all my games? What happens if Xbox Live servers are down for 24 or more hours?

All of this is unnecessary bullshit. The real upper cut is that renting and selling will not be available at launch, which will likely decrease sales as I imagine during the launch period people probably trade in more games to help purchase new ones or purchase used to help offset the $400+ they just spend on a new console. Hell renting games at launch is really important, if my friend and I both purchase Xbox One's we can purchase two different games and trade once we beat them to help save money, and I can only imagine that is fairly common.


To your point about our service men and women, they would be unable to use Xbox One's at all because they likely do not have access to internet on certain bases, if at all. Microsoft better pray to the computer tech God's that Xbox Live is never hacked, because the second Xbox Live servers are down for more than 24 hours because of a hack or for any other whatever reason, like the Giant Bomb crew said, the entire system will crumble and they will be in a load of shit. At least when Playstation Network went down for 30 days, every could still play offline, the same will not be true of the Xbox One.

Screw Microsoft. I am a die hard 360 player --who finds himself using it less and less playing SWTOR-- but I have not an iota of an intention of getting a XBONE now. This console seems to despise gamer's, and goes out of its way to make their hobby as frustrating as possible.

I'll be getting a PS4 for sure now. My Sister and bro-in-law asked what new console they should pick up this holiday season for their young family to enjoy. I'll tell them if they want to avoid untold frustration and headaches to avoid the XBONE like the plague. Sony seems to want to woo players, Microsoft acts like it hates our guts.

Sony had to reduce their game sharing from 5 consoles down to 2 because of how abused it was. I don't believe that Microsoft is going to allow 10 people without serious restrictions that they aren't telling us.

A lot of people are forgetting that the problem with the 24 hour check in isn't about your connection, it's about MS's connection. You are at their mercy; and as a consumer, you should not accept this on principle.

And they have not laid out a plan for what they'll do once they shut off servers. They'll probably release the DRM, but can we be sure they will? They have not said anything on the matter. Your entire game libraries could potentially be destroyed on a whim.

Steam ain't perfect either, but they've actually provided "outs" to these concerns.

lol, well at least some people are absolutely fine with it. I'm definitely not. I can only hope that Sony doesn't follow Microsoft step-for-step. Time will tell.

The cynical part of me says that they just want the ad revenue from people connected online. The fact that they put ads on gold accounts on the 360 is enough to say that this is not beyond them.

The only other reason would be anti-piracy, but that can't be the only reason for how many people they are inevitably excluding from the system with this requirement.

Another reason why I love Giant Bomb, the comment threads. Here on this site we got different ranges of opinions and no one is getting flamed if their opinion differs from any sort of majority.

If you go and look at Kotaku, not only are the writers posting articles saying this sucks, but the majority of their readers are filling the comments section with hate and going after anyone that even whispers they are OK with these policies. I'm really glad to be a paying member on this site

@desolatehero: well for one this essentially screws the military, and id have to imagine those guys need entertainment like an xbox

and then a lot of it is that people are not confident in microsofts servers, because now that this is the route things are going, their servers basically have to be goddamm immortal.

I realize most of this has more to do with publishers dictating these new requirements for DRM, but still. Kinda sucks.

I'll wait and see how it really goes. I mean it isn't THAT much of a headache with PC games and Steam/Origin. But consoles are obviously a different beast.

Cellular internet is only getting faster. Wifi-hotspot functionality/cellular based internet is available for many people. I'll also point back to Steam and iOS for the other points. Those stores exist and function very similarly.

Finally I will say again, you should talk about how this will work for you instead of speculation about how it will or won't affect other people.

@desolatehero: Finally a rational comment. I'm not crazy about Xbox One and it's offerings, so I won't be buying it. I don't need to rant endlessly just because it's cool to hate on MS while ios, Steam and Android get a pass. If you don't like the new system then don't buy it and move on. So basically, Gamestop gets a carve-out deal to keep them happy, and everyone else can go fuck themselves.

I mean, let's think about this. Under this system, can I sell my games to people I choose on eBay, or in person, and make the most money possible from that sale, as a consumer? Nope!

But I can go trade it in at fucking Gamestop, for whatever horrible pittance of a deal they deem me worthy of receiving, paid in their own closed system of exploitative, de facto company scrip.

This is the worst capitalism ever. This shit should be illegal.

Easily the worst reveal of a console ever, their is actually not one thing to be excited about for people outside of America, everything they showed at their "unveil" was for Americans with super high speed internet. They are pretty much turning this console into a PC, that is not what I want with console gaming, I want to be able to trade around games with friends, be able to pull it out of the closet in 20 years like I do the SNES. I have never pirated anything on the 360 but I hope pirates crack the Xbox One and turn it into a offline console.

Been a Xbox gamer since 2006, but if Sony doesn't have this DRM bullshit I will buy one, they are in a strong position at the moment if they don't fuck this up, the have the more powerful console, the have shown to have the better exclusives on the PS3, all that sharing stuff is actually pretty cool. Talking to my friends on the 360 they all feel the same way, I feel Microsoft is taking their user base for granted.

Swap out "Steam" and "Valve" with "Xbone" and "Microsoft" and you could print this today as relevant news. Stop with the hyperbolic bullshit.

While Microsoft did say their making sure their servers stay up, the problem with the internet connection is on the user side that have questionable bandwidth limits and drops.

For people who saying that their connection is good, how much are you paying for your internet service and how often does it drop connections?

@milkman: EA doesn't have the balls. At most they'll give MS some timed exclusives (see Titan Fall, a timed exclusive btw). The Xbox isn't a viable brand outside of NA/UK so they aren't going to leave money on the table. Also, the Xbone is fucked in Europe if they go through with this.

That's actually going to be straight up crazy. The UK in particular has incredibly strict (by comparison) consumer protection regulations, what happens if the XBOX turns out to be unmarketable in the UK? Would they engineer a version of the box that no longer supports the offending features? What then? modders would be all over that thing like white on rice.

Jesus guys I just want to play Forza 5, this is going to be a weird generation.

I really don't see the next gen consoles having so clearly a line drawn in the sand as "PS4 won't have DRM, but XBOne will. PS4 won't have any online checks, but XBOne will" Every generation for each thing we think one company does that is crappy, the other one has a slightly altered, yet just as crappy. So far PS4 has done a better job of being vague about their policies because their initial stance is clear.

Sony said the PS4 will support used games, but never said how. Sony also said the console will not require an always on connection, yet they never said it won't require the console to have an online check. Once the dust settles from E3 we will know what each console is really about. I personally believe that Microsoft wouldn't have come out with all their policies first unless they had an idea what direction Sony was going in.

how about instead of leaving used game purchases and sales up to the publisher and gamestop, leave it up to the customer who paid $60 for your game?

This is literally the worst, because now individuals lose their right to sell their items, unless its to a major corporate entity that partners with microsoft. If I want to sell my game to a buddy for $20 I cannot do that. Xbone stinks.

This is actually a good point.

In general I think the Xbone has too many weird, complicated or borderline creepy sides to it that makes me not want anything to do with it. Microsoft seems to have bitten off too big of a bite - they want too much this time around, it's like they think this is going to be the same revolution for our livingrooms that the iphone was for phones in general, and I can't see it happening. This is all a slippery slope down a path where you lose more and more control of what you own. In general their approach seems too dumb, greedy and ham-fisted to succeed.

Ps4 sounds like a much more appealing system to me. I just want a nice system to play games on, with a nice simple controller, and if it does other multimedia and streaming stuff well - great. I do NOT want to talk nor wave at my console to operate it.

ah you aint in no trouble with me at least, we're having a rage-free decent conversation (feels like a rarity to have these with a random internet dude these days :P)

i agree with you on the celluar internet stuff and wifi hotspot stuff is available for many people.but even those have caps. sure the caps will increase over time but in relation to using your smartphone/hotspot's service for online gaming, i would have to imagine that would only be a means to an end to ping the xbox to authenticate your game every 24 hours, cause id just have to imagine playing online multiplayer will just devour the monthly data people get.

regardless its still an extra layer of complication versus the simplicity they had before.

Now to the point about steam and ios,

you can play games from both of those stores offline with no restrictions and no requirements to check in (was watching the tnt today and rorie said that unless the game requires online like a mmo, you can play steam games offline, correct me if thats wrong as i am not a pc gamer)

for the most part just judging from comments here and other places, people are mostly fine with the used games scenario, its this 24 hour check in is the problem. which there are legitimate reasons for concern,

as for saying how this would work for me. well ultimately for home usage its fine, but i just dont have the confidence in microsoft's servers to buy all my multiplatform games on the system that requires an online check in for them to even work on the thing, and if sony comes out and says they have an online check in requirement to play games, i might very well go the PC route then.

and also there is something to be said for the users who are raging about this and bringing up issues that impact other people and not them

,call me crazy, but in a weird way, it kinda shows the internet isn't all that evil as people like to generalize about.

Aside from the DRM thing they actually had some reasonable answers, and even that isn't as bad as it could have been. It's still abominable business, but it doesn't affect me as I don't really re-sell games, ever.

I'm just wondering, if the price drops a couple of months after a game's launch, it'd be just as feasible to get everything digital.

With Xbox One you can game offline for up to 24 hours on your primary console, or one hour if you are logged on to a separate console accessing your library. Offline gaming is not possible after these prescribed times until you re-establish a connection, but you can still play your PS4 instead.

I'm on board and ready for the next generation. A lot of this sounds pretty reasonable and some of it actually sounds kind of awesome. It is a bummer that if I'm moving to a new apartment or taking my Xbone on vacation, I won't be able to play the games when internet is lacking. Still, this isn't a huge deal for me.

I'm not happy about this but I can live with the new policies. Though I do share/sell games with my friends. Also I thought this was interesting:
