Say Goodbye to SOPA and PIPA (For Now) [UPDATED]

Votes on both pieces of legislation have been pushed back for the time being.

UPDATE 2: As pointed out by some colleagues, it's probably too far to say the ESA has "dropped support." In essence, the ESA is simply admitting defeat with SOPA and PIPA, and is advocating for additional legislation. There's no telling whether the ESA would actually change its position with any future legislation.

UPDATE: And at the last second, the Entertainment Software Association has dropped its support for both bills. This might have been a bit more useful to advocates a few weeks ago, as today's other announcements have the bills dead in the water for now.

Here's the organization's complete statement:

"From the beginning, ESA has been committed to the passage of balanced legislation to address the illegal theft of intellectual property found on foreign rogue sites. Although the need to address this pervasive threat to our industry's creative investment remains, concerns have been expressed about unintended consequences stemming from the current legislative proposals. Accordingly, we call upon Congress, the Obama Administration, and stakeholders to refocus their energies on producing a solution that effectively balances both creative and technology interests. As an industry of innovators and creators, we understand the importance of both technological innovation and content protection and are committed to working with all parties to encourage a balanced solution."

SOPA (Stop Online Piracy Act) and PIPA (Protect IP Act), at least in their current forms, are no more.

You can thank the endless headlines generated by this week’s Internet blackout, plus the kicking and screaming from technology companies opposed to Hollywood’s legislative push-back on piracy.

House judiciary committee chairman Lamar Smith (R-Texas) and Senate majority leader Harry Reid (D-Nev.) both announced plans to delay any movement on either piece of controversial legislation.

“I have heard from the critics and I take seriously their concerns regarding proposed legislation to address the problem of online piracy,” said Smith. “It is clear that we need to revisit the approach on how best to address the problem of foreign thieves that steal and sell American inventions and products.”

“There's no reason that legitimate issues raised about PROTECT IP can't be resolved,” said Reid on Twitter. “Counterfeiting & piracy cost 1000s of #jobs yearly #pipa. [...] Americans rightfully expect to be fairly compensated 4 their work. I'm optimistic that we can reach compromise on PROTECT IP in coming weeks.”

The issue hasn’t been tabled, just delayed. SOPA and PIPA will come back with new names, and new attempts at regulating piracy. Hopefully, they’ll come back with something more reasonable.

Get the feeling ESA only backed out of their SOPA/PIPA support once it became clear that they were stalled. They probably still support it, but as the pro-SOPA/PIPA forces make a strategic retreat the ESA's trying to cover their backsides. They will probably show their real colors once the reworked versions of SOPA/PIPA re-surface.

Stealing = taking away something, Internet piracy = downloading, downloading = making a copy of something, not taking away what was originally there.
 
You can make the argument that downloading is stealing money, money that you would have had to pay but there are holes in that argument such as "I wasn't going to buy it anyway!" etc etc

@Sooty: If it makes sense to you that the person distributing the files is doing something wrong but the people are receiving them aren't, then I don't really know what to say. I think you're hung up on a definition of stealing that only includes physical objects. People can tell themselves whatever they want to feel better about not paying money for products that rightfully deserve to be paid for, but it won't make it less wrong in the eyes of the law.

No one in the general public knew about SOPA/PIPA until really recently even though they were first introduced nearly a year ago. Congress wanted them to be quiet, so the tech industry had to throw a fit to get anyone to pay attention.

Considering there has not been much of a drop in total revenue in the games industry and that the market has been trending upwards dispite a serious recession, I find it hard to believe that real people are losing jobs over piracy. We have also seen the biggest releases in video game history within the past couple years. The video game industry has been healthier than ever in my opinion and the dissolution of certain companies and the rise in mobile and indie games is not a bad thing. That statement about piracy has never been quantified in any accurate manner and is no more than speculation at this point.

You would have a much more sound argument that piracy helped expand the market and increased the health of the industry and at least you would have numbers to back it up. I am not defending piracy, copyright infringement, or theft and would like to see reasonable services that provide a legal alternative. I just think that statement is full of shit and only people who have no familiarity with economics and business would believe it. I find using blanket statements like that one to generate support for actual legislation that takes away individual rights and bypasses the legal system entirely is surely unethical.

It's a good ole' Maddox article, but a little more then halfway through he does list all the companies that are actively supporting this legislation. But I'm sure you can hit up Wikipedia as well and obtain that information if Maddox isn't quite your form of preferred reading entertainment. As we've seen over the past few days/weeks, most video game publishers seem to have distanced themselves from SOPA/PIPA. Sony Entertainment, Microsoft, Electronic Arts, Activision, and a few others were listed as supporters before the "blackout" day hit.

Agreed. Hopefully we come somewhere between this and SOPA/PIPA where anti-piracy measures are given good, sharp teeth while legitimate sites are left the hell alone. I think we're going to see a year, maybe more, of discussion on this issue before we get a final law, but I think everyone will be better for it. The fast-track attempt for SOPA/PIPA was shameful.

new name and new wording is right after all those two bill are nothing more then a new name and new wording of a bill submitted a few years ago and that a bill submitted years before that.  They have been trying this shit sense the cassette tape was invented they aren't after pirates they simply don't want their stuff copied period.  The freedom to share with others cuts into their bottom line. 
 
It will pass sooner or later if they dump enough money into forcing that thing through it will pass after all the banks got all their shitty bills passed and they don't have anywhere close to the amount of money the  entertainment  industry does.  The entertainment  industry is just behind oil in other words the second largest industry in the world they bring in more money than your average country.

OK EVERYONE!

Instead of rationalizing piracy and bitching about Hollywood buying politicians (while ignoring the same behavior from tech and internet companies), how about we talk about a solution to the problem?

Personally, I'm hoping that with the SOPA/PIPA mess in the past, there'll be some momentum for OPEN, which does a better job at targeting pirates without damaging the broader internet.

I'm fine with laws that punish criminals, but not ones that punish the mechanisms of free speech. You don't bulldoze the school because kids are smoking in the bathroom.

Also, I'm pretty sure West & Zampella rightfully expected to be fairly compensated "4" their work too. Shame it wasn't their IP anymore, or the law might have given a damn.

Notice how they say 'pushed back'. We're still not out of the woods yet. And I highly doubt piracy makes enough of a dent in corporate pockets to cost as many jobs as Reid says they do.

I'm happy with how support has gone against SOPA and PIPA at large, but at the rate the US government is going, it's only a matter of time before it's tried again. Our freedom is being slowly ebbed away mostly unnoticed and mostly uncontested. Little pieces of SOPA could easily get attached on to other unrelated bills which will get passed because they are necessary. I hate to be a pessimist, but I hold out very little hope.

Now, granted you can tell a politician is lying by their lips moving, but it should also be noted that the 4 major Republican candidates (Gingrich, Romney, Paul, Santorum) spoke out against the bills during a debate this week in South Carolina (source: Ars Technica). So, with now widespread disapproval of the two bills, it's a good sign that cooler heads have prevailed over the "lock-out everything" mentality Senator Leahy (D-VT) has.

It doesn't. Hollywood's profit growth year over year are in step and actually about 1% ahead of year over year overall American economy. This isn't about profit, its about *more* profit. Not enough Bucatti's in driveways, too many Ferrari's.

Piracy is a service problem, and always will be. The only way to chip away at piracy (you can never fully stop it) it to provide better service. Make it easier and more appealing to the potential consumer to buy vs pirate.

Steam is an excellent example of this in the PC world, as for a very long time it was simply fucking easier to pirate a game than to aquire it in literally any other capacity. Lousy cars that take gas to operate, attempting to keep spares / backups of your physical software library and all of the other roadblocks that existed until a proper digital distribution service flourished made going to your local pirate bay tons easier than driving to the store. Now its way easier and more compelling to just use Steam, with achievements, cross game groups and voice, etc.

Netflix and Hulu are on the right track from a service perspective, and Netflix's profit margins reflect this. People very much want a proper digital distribution platform for Hollywood, but its not quite there yet, and still very much evolving. The ala carte services like itunes are also getting there, but its still a little too expensive.

I just want to say, their piracy figures are bullshit. I think they're assuming every single illegal download will turn into a purchase, if the usual piracy sources are no more.

Piracy isn't the same as theft. I don't support it but I really don't think those supporting the bills know the difference.

So in other words the massive media distraction proved very effective and they are putting it aside to pull out again later if need be. Think about it, everyone got so worked up about SOPA thats all you heard and read. Nothing about Occupy Wall St, or the terrible job market that is not getting better or etc or etc.

In mexico, in every single street's corner you can buy pirated games, cds, movies, and all kind of counterfeit products. WTF even when crossing the border from Mexico to Texas, on the mexican side, there is people walking on the streets selling you pirated dvds ("giving you excellent service") directly to your car's window.

Maybe magaupload should move to Mexico, nobody cares there.
