In the room where you left the warden in the penitentiary. It's on the ground in front of the chair he was sitting in.

@Chaser324: This one was bizarre, was the game really expecting us to just searcht he whole island for it? Or are there some hidden clues somewhere?

You had to listen to them and deduce who it is.  The achievment is not called "Worlds Greatest Detective" because it was going to be easy.

In the room where you saved the warden in the penitentiary ( I think) You know, same room as Clayface.

@hughesie27:   It wasn't too hard to figure.  I just thought out of all the characters still there in the Asylum it was probably him since the voice is kinda similar.

Same. It was a very Scooby-Doo-esque moment for me. And because I had been reading the Character Bios, I knew--almost immediately--who the Spirit was.  
 
Personally, I really like the interview tapes. The Scarecrow tapes are particularly interesting.
