It's possible some employee stole the code I guess. It's also possible your box somehow didn't get a code at the packing facility too. Wouldn't be the first time that happened. Just be really thorough and page through the manual, make sure it's not inside any case or anything.

When I tried to take it back they said they could not because the game was opened.

I assume you're talking about the PC version? If so the game doesn't require the key to be played, you just don't get Games for Windows Live - which is no major loss.
Edit: If you're absolutely sure it's not on a sticker in the manual, in the box, behind disc etc. then you should be able to contact the publisher to send you a new code; in turn you'll have to send them proof of purchase.

I don't think i had to use the live access key for Fallout 3 for my pc, but my live access key was located under where the disc rest with a rounded rectangular sticker, so maybe someone didn't put the sticker on during the production process for Fallout 3

hmm it is a pain , long shot is you could go back and make formal complaint , might scare them into giving you a refund or exchange for another copy. Even so it does sound more like it fault of microsoft so i would try giving them a call first.
