Since 3D Realms is Bankrupt, isn't Duke Nukem Up for Grabs?

I was always under the impression that when a company goes bankrupt, they must sell off all of their assets. Considering the fact that Duke Nukem is a asset, wouldn't a company potentially be able to purchase it?  They could even purchase the game assets/engine as well I believe.  Do you guys really think no ones wants this license?  Same goes if Midway had gone bankrupt, Mortal Kombat would probably be picked up as well.

Wait, do intellectual properties actually count as assets? Does anybody know the status of IPs?

Well as far as i am aware take two still hold the publishing rights to the game however the recent news is that take two are suing 3D realms for not delivering the game on time. Who knows if we will ever see due kick ass and chew bubblegum
