No. They aren't alive. Therefore they have no rights. Asking if a zombie has rights is like asking if a mallet or a nuclear warhead has rights.

Jakob i saw that movie.. that shit is funny and totally what i'd do and wtf with the vegetarian zombie XD.
But... zombies arent human, say i make a pie and shit on it... technically it still looks like a pie, but its not actually a pie.. its pastry with shit on it. Same with zombies.... pretty much.

I agree that they are very important, they inspired one of the best games.. dead rising, and one of my fantasies.. Zombie Apocolypse.
A Vegetarian zombie just takes the piss though, and kinda insulting, whats next, A zombie with no teeth.

I think that's why I liked Samuel and the Professor the most in that flick. They understood the point and the purpose.
I'd have to agree with the points you made, I didn't vote "Yes" though.
I'm no Zombie advocate, but I voted yes. They are technically still human (well, reanimated). They lack a soul, which would make them an animal, yet they still have primitive needs (e.g. a desire to eat brains) and they have basic low level of speech. Would there be a Zombie ACLU?
By current law they do, whenever a person dies (which zombies have) they still have the right to their intellectual property for 20 years. With normal persons that right gets inherited but a zombie has no real reason to give it away. So if ever a zombie make a kick ass pan flute song he still keeps the right to make and sell cds with it on them for 20 years.
I'm pretty sure the Consitution says something about life. Once you're dead, your rights are gone.

Being that under current federal law the unborn have no rights, I'd wager a guess that the undead would not have rights either.
Its a tough call, probably would have to be taken up by the Supreme Court, and there would be a lot of lobbying by special interest groups on both sides of the issue trying to sway the minds of the American public.
I could see the media running with the issue, and labeling those that would push for zombies to have no rights as the "Anti-Undeath" crowd and writing scathing editorials about said groups, accusing them of various forms of bigotry and religious fanatisism.
The Zombie Holocaust is going to be a fun time indeed.
