Well i have been using a pretty decent one for some time now but lately its been acting up and not converting the video properly. So I'm wondering if any of you guys have any suggestions on a good free MP4 converter that is able to convert to mp4s that can be played on an iPod Touch.

If you have a Mac, iMovie HD is amazing at converting videos, and not too bad for editing. And it's free!

I use a program called Super these days, it's a really fantastic program IMO.  No codecs required AFAIK, and it easily converts all sorts of things from resolution to frame rate and it all works very well and it's FREE.
