    I'd say it's best to play it safe and wait until release. You could try contacting Rockstar directly or checking on their website.

    As far as I know they'd have no legal claim to it. It's not like you signed an agreement saying you wouldn't post video until a certain date. The content of the video is created by you since gameplay is depended on player actions so you would hold the copyright. They might have some claim to cutscenes since those are created by them and do not differ based on the player. Just make sure you don't have any music playing that could get it taken down.

    I've heard rockstar is notorious for hitting youtubers with copyright violations. There are a good amount of people who consistently do let's plays of new games and don't bother with rockstar games till well after release.

    I guess if you're a smaller channel with few subscribers/views and you have ambiguous titles to your vids you could probably get away with it i guess

    I actually love it when they keep pulling gameplay footage. A couple of days of chasing Red Dead Redemption videos around Youtube blew my hype out through the roof. 
    But yeah, you're probably gonna get in trouble.

    Probably the very worse case scenario is a similar penalty to selling copies of movies or allowing people to mass watch said movies for free.

    Like a 250,000$ fine and or the 5 years in Jail thing. That seems quite extreme and would never happen but I could see the threat being there.

    More likely to happen is Rockstar makes you remove the video. No harm no foul. Probably a realistic worse case scenario is they force close your entire channel.

    I don't even think they could fine you if you could prove you were using a legit copy. 
     
    They'd probably just issue a copyright notice to have the vids removed and/or your channel shutdown

    I don't think you'd get in any serious trouble, but Rockstar would take it down swiftly.

    I don't think so. I remember watching some guy play a few GTA4 missions on youtube and all the videos be taken down.

    If you've got a copy, then other people do, and if there aren't videos up already, it's because they are being taken down fast. Basically, don't bother unless you use some less-reputable video site.

    I'm pretty sure you need three copyright notices to get your account shut down, a I think it resets after a year. That said, vids like that for Rockstar games usually get taken down before release date.
