Send it back. If you only bought it today you shouldn't have any problems. I haven't had your problem so I don't know how to help you on a technical level.
Take it back to the store. Have them plug it in and if it doesn't work, than demand a refund for a defective product. If you just got it, there should be no hassle.
@chrisone: If you bought it normally (aka it was sealed) take it back to the shop with the agreement booklet, show them your rights and trade it in for a new one. The same happened with my kinect which broke day one. The store told me to send it to Microsoft myself, that it was my problem now. I taught them some manners by whipping out the user agreement thingy mabob (you know the grey booklet you never look at), walked out with a brand new kinect.
Oh I forgot to add, it was in a Tax Free store at an airport in another country :p
So it might be hard to just go back there :/
The nice person in me is desperately trying to hold myself back from saying you kinda deserve this... ; )
Edit: I'd try to contact Nintendo if you have no hope in getting back to where you made your purchase. Unless you bought it from some dude in a trench-coat.
Nope, it doesnt.. I guess i just have to send it to Nintendo and have them fix it. I still have the receipt, so it cant be that hard. I just wanted to play me some mediocre Ghost Recon anyway. (Yeah yeah flame on :P )
