Suing Sony

I think I'm finally at that point. While I'm a firm believer in Capitalism, I also belive in holding people (and corporations) accountable for their actions.  The lack of security, the removal of promised functionality, and the most grievous error, keeping us in the dark about our personal security has pushed me over the edge. I'm sorry Sony, but you have failed miserably.

After reading the whole thread there's a lot of stupid going on in here.   End users have every right to sue Sony over this situation, and there will be a class-action lawsuit unless Sony is extremely generous in the aftermath of this debacle.

If there is a class action lawsuit the most that will come of it will probably be a $10 check to every user who tried to logon during the outage.

I don't think it will come to that, I've assumed from day one that Sony would give out vouchers for the outage.  I had assumed maybe $5-10, but since it maybe another week, probably at least a $10+ credit to everyone's account will most like occur.

So far as the other stuff goes, there's probably something in the long-ass agreement you have to agree to in order to create a PSN account that covers it.

it's not the secure part. It took them 6 days They should have sent an email saying "we have have been compromised" on day one! That's my issue.

Yeap.  Sony screwed up, sure.  In fact, imo Sony is pretty terrible at providing an online gaming environment comparable to Steam or Live.  This latest screw up is just par.  Despite my opinion though, we all take a risk when we share personal and financial information with a company.  Suing is pointless and wrongheaded.

They don't know yet if personal details were stolen , they said they might untill you know for sure you can't really sue them. As for the down time unless you paid for the PS+ (and most people don't) you need to grow up and realize the shit happens just like it happened to Amazon.

Clarifying a Few PSN Points

We wanted to take this opportunity to clarify a point and answer one of the most frequently asked questions today.

There’s a difference in timing between when we identified there was an intrusion and when we learned of consumers’ data being compromised. We learned there was an intrusion 19th April and subsequently shut the services down. We then brought in outside experts to help us learn how the intrusion occurred and to conduct an investigation to determine the nature and scope of the incident. It was necessary to conduct several days of forensic analysis, and it took our experts until yesterday to understand the scope of the breach. We then shared that information with our consumers and announced it publicly yesterday evening.

For those who were looking there’s also an FAQ with some more on frequently asked questions

Thank you for your continued patience and support.

I was going to post this myself, though no point now. We can't prove Sony didn't know anything before the told us, and anyways they're STILL saying maybe

Speaking of stupid going on...
Having the right to sue is almost always an irrelevant point. I have the right to sue you for taking a shit last week. Having grounds or any hope of success is another matter entirely. Outages of online service (or the full elimination of services) is not actionable in any meaningful way. The EULA makes this clear, and every attempt to sue over such petty bullshit has been laughed out of court (Stateside, at least).

As for the possible credit card issue, I doubt any legitimate suit could come from that. One has to establish damages in a civil case. Between Sony's relatively fast warning to consumers (anyone who isn't an ignorant shit-heel recognizes that it is fast), the scale of the potential threat, and the increased ease of handling security issues with banks and credit companies, I think you'd be hard-pressed to find anyone with actual damages when all is said and done.

Any vouchers or services that Sony may provide will be a matter of pure PR; from a legal standpoint, they're at virtually no risk (based on all available information).
