Well let's not condemn the guy before he has his day in court and the facts come out. Come on people. Yes these are VERY serious charges. But he's just been charged. Not found guilty.
Do they still teach civics in school? Who am I kidding. This guy's life is ruined no matter what the facts are.
This thread just proves that. I'm glad someone beat me to the point though. Until he's proven guilty, most of you are just talking out your asses, and contributing to the ruination of a potentially innocent man's life.
This may be the first time I heard someone from the Game Industry being charged with child pornography charges. No matter if the guy is guilty or not, the public opinion of him and of the studio, which wasn't in a good place to begin with must be in the gutter by now. This is bad news all around and the only hope they could have at this point is that the guy will be proven innocent.

I think this Danish movie "Jagten" talks about this subject quite well and really illustrates the irrationality of society when charges of under age sexual acts are brought up.

Considering that its becoming a growing habit of western country's to ban even hentai as a possession of CP i'l just wait till we actually know what he is being charged with. Most of the damage has likely already been done as hes immediately shunned by friends, colleagues and family and can likely say goodbye to his game developing career just out of fear of being associated with the guy.

As much as I believe it's a complete violation of privacy and the government overstepping its bounds, I do want to be able to call up my ISP and tell them to turn on the porn hose. Turn it up all the way. I got a whole weekend to fill.

Company CEO Paul Caporicci confirmed on the Precursor Games forums that McCulloch is no longer associated--in any way--with the studio.
"Having just learned of these disturbing charges today and based on the serious nature of them, Ken McCulloch is no longer affiliated in any way with Precursor Games," he said.

McCulloch was a founding member of Precursor Games and, prior to his arrest, was listed on the company's website as "Lore-keeper. World-Builder. Dream-merchant." His employee profile has since been removed from the site.

It's annoying, because (like the DRM argument) it's basically putting hassle on everyone for something a minority do, and I don't think it'll work from either angle.
1. I'm confident teenagers know a lot more about the internet than their parents do, so it'll take them mere minutes to get around it. Are we supposed to believe no one will ever use a VPN or a proxy browser, or should those be blocked too?
2. I imagine if you're of the inclination to download child porn, the embarrassment of calling up your ISP just to enable access to 'regular' porn is a small annoyance, considering you'd then get access to the 'caffeine-free' stuff and people would be none the wiser of your intentions.
3. Since logically this automated system would require records of some sort, it's not much of a stretch to picture your ISP essentially holding a database wherein every person is a potential sex offender. One day that'll work out really badly for someone who didn't deserve it.
Finally, and this is a problem in legislation everywhere, but it really bothers me when this sort of thing is insisted on by people who don't even know how it works. Google doesn't own the internet and neither does my ISP, nor is it either's responsibility to police it. My ISP is a doorman, not a curator.

Yeah that was my assumption. But if he was making and distributing it (They said they seized numerous computers, though many of those admittedly could be work PCs) then it's far, far worse.

In regards to confusion about the "my computer was hijacked" defense: Actual personal computer hijacking in the manner in which I think some of you are referring to it in this thread is pretty rare. There is one much more plausible scenario for a user to unknowingly (well kinda) allow other users to access illegal content through his system. I'm not sure how familiar the public is with how VPN's work? Long story short, if you are a supremely trusting person who believes strongly in the preservation of internet semi-anonymity, you can volunteer your system to act as an end access point for the network. The last access point in a VPN network runs a normal internet connection with no encryption, which means law enforcement does have access to information about that system through its ISP with a court order (depending on country of origin). There have been several cases of people running VPN end point servers being raided by law enforcement and equipment seizure carried out. If any of you are familiar with Wiki Leaks and the roundabout ways they keep their content online, this is similar. The shitty thing about preservation of internet anonymity -which has many righteous uses for journalists, law enforcement themselves, military, and residents of internet censored countries- is that they can, and are, used to facilitate criminal operations. Which makes a resourceful criminal difficult to catch, not to mention the red tape horror involved with international criminal cases.
The existence of VPN's is a tough issue for me. There is good that does come from them. But in turn... they open the door to a whole mess of horrible atrocity. I don't know. I don't know what to do about it. :(

Ah, yes, this is an additional point of common confusion with the law. According to the article:
McCulloch is charged with one count each of possession of child pornography, making child pornography available, and accessing child pornography.
In layman's terms, respectively:
Charge 1: saving a copy of illegal content to his personal hard drive(s)
Charge 2: this one means posting illegal content from his personal computer back up to the internet. In this case, and with this wording, it means he did not personally create what he allegedly posted, otherwise the charge list here would include several additional entries.
Charge 3: willfully looking up illegal content with full understanding that he allegedly knew exactly what he was looking for.
