the game is out may 1 here in europe and i got it in the mail today, should i wait to play the game before proper realese date? can i get banned or punished for playing it early?

I think you'll probably be okay. I picked up a copy at a store in my town(in Texas) yesterday. Seems like some copies are getting out early. This one of the reasons I still prefer physical media over a digital download.

The only way you you could get into trouble is if you did something illegal to get it (eg theft) or illegally downloaded it (you could be banned for example Halo leakzzz.) If you bought it from a store/online then they are at fault for selling it and you should have no problems.
