However if your reading comprehension were as finely tuned as your ability to attempt patronising sentences then you'd notice I never mentioned climbing said tree.

Actually, I would have cut that shit down. Did you see how many trees were in that area? I don't think anyone would have missed that one tree cuz there's like a million others. Hopefully I would have taken down a nest of endangered spotted owls in the process, cuz one of those bastards killed my pet mouse the other day.
The second balloon, which is shown in the video, landed on top of a very high tree. That tree was very dangerous to climb. EA representatives at the sight told people not to climb the tree, but trying to tell people what to do was kind of silly on their part since EA is not the police or anything and has no authority to tell people what to do or not to do in a public area. So then, when they saw people were not listening to them and climbing the tree anyway, they said they would not be responsible if something bad happened. Again, that is pretty stupid, since obviously had a disaster occurred, it's not hard to see that EA would've been held at least partially responsible, since they are the ones who sent the video game in a balloon and a likely outcome was that it would end up on top of a tree
So let me get that straight. EA doesn't have the slightest authority to prevent you from doing something utterly stupid (true) but if one of you guys got hurt by that something utterly stupid, they would've been partially reponsible.

You guys must not be from America b/c people sue (and win) over ridiculous things all the time. E.g., some guy jumped in front of a subway train trying to commit suicide. He survived and sued the city b/c they failed to adequately protect him from jumping in front of a train. In this case, EA is definitely creating a danger b/c they're encouraging people to go on a treasure hunt for their game. You gotta figure that people are crazy enough to put themselves at risk in order to get said game. EA is really lucky that no one got hurt, and I'm surprised their lawyers allowed them to pull this kind of stunt.
If it were me, I'd have shot the very edge of the box off of the tree with a BB gun. Of course, that would also take forever and I may damage the goods, though still beats climbing.

Well anyone can SUE for any reason. It just takes filing some forms at the court
For example if I played my Nintendo 3DS while walking on the street and I did not look where I was going and banged my head on a street lamp, I could sue the city for having the lamp there
the question is whether a court would actually discuss the case. or whether it will be tossed out by the judge

Oh you mean the lady who had 6% of her skin covered in 3rd degree burns who sued for $20,000 to cover her 8 days in hospital and surgeries? Then McDonalds offering her $800 because, hey, she is too dumb and poor to afford a good lawyer. That case?
