Funnily enough, the site now reflects Jeff's above comments in its statement. This thread was obviously seen by the author, as it should be. Even if it does have tits that will definitely not change it to anything close to an AO rating. Godfather II, God of War, and others have had it with no problems. It is a sad day when two breasts cause a game to be unable to be sold at retailers....
This isn't to avoid getting an AO. This is to try and screw over the used market with the one time use code. They probably realized once everyone realized how shitty their last few games were they turned around and pawned them off. I guess they want to prevent that from happening again.
I think it's a bit early to say whether or not the DLC content is "AO worthy". I mean, sure, the article mentions nudity, but other than that it is difficult to say how explicit the material is. I wonder if this will mean we will start getting 'uncensored & uncut' patches with a new Manhunt or GTA.

It will receive the same rating as the game no matter what I believe. I think I have seen DLC before not rated at all, and rated the same exact rating as whatever rating the game its for gets..so maybe its not a must, but if it does receive a rating, it will be M just like the game.

The linked article suggests that DLC could potentially change a game's rating. It would just need re-branding, a la San Andreas. So I guess it would then be a completely different SKU, and therefor a different game (as far as the ESRB is concerned). But the question is, would the DLC be expandable to the original SKU of the game? Because I can see Rockstar (or someone else with crazy balls) exploiting that loophole to release an AO game.

Except its not allowed at all as far as I know. If someone were to do something like that, they simply wouldnt allow them to release it at all. It has to be the same rating as the game.

I'm not sure about that. The wording makes it sound like they'll allow it, but it will not only lead to the game being re-rated, but the publisher will be fined for essentially lying to the ESRB about the content in the game.
@jakob187: That's what I'm wondering, surely if the content is DLC then it would be rated AO. I didn't think MS or Sony allow for AO content over their online services...

Thats a little redicioulus that DLC can change the rating of a game. I think that there should be some warning for the DLC but not changing the game rating. Looks like a great game, can't wait to get it and play!
