    What I get for going to Gamestop I guess.  I'm sure I can get my money back tomorrow, but I have a question about my Live account.  Since I tried to sign in on the banned 360, will my account be banned as well? Or is it strictly the xbox that is banned?

    I would bet the serial number or something get's banned. I thought you could only get banned from XBL, not the entire Xbox.

    I'm surprised anyone aware of the ban would be willing to buy a used 360. You really can't be surprised, like, at all.

    I'm sure the banning of the live account is separate from the banning of a system.  I don't think signing into a banned xbox using a legit ID will ban the account as well, you just won't be able to get on live since the system is still banned.
     
    You'd think gamestop would check for something like this, reselling a used console which essentially has all online functionality disabled is a blatant scam.  Given that this can happen, they should check that the console works and can get online before even buying it from the seller (and not buy the unit if it doesn't work).

    to check if your account still works try signing onto the xbox live website.  You say you put faith in Gamestop, but it's funny that the real problem here is that Gamestop put faith in it's customers, by assuming the 360 they were given was functional after a quick test.  I guess they just didn't test it online with gold membership account.  Some dick out there thought he was going to screw stupid Gamestop over by giving them a banned 360.

    Before anyone asks wtf did I buy another Xbox when I already have one, well, the answer is because my other one won't be back for about a month.  By then my classes will have started again, and I won't have time to play some of the games that recently came out.  Yes, I realize I'm losing money, but I rationalized it by telling myself that I can sell this Xbox when I get my original one back.  The difference that I lose will simply be a "rental" fee.

    @Hailinel: That's true to an extent, but on the package, it says "Certified, Restored to Manufacturer's Original Condition". 
     
    I didn't pay too much attention in my business law class, but I believe that to be an express warranty that my Xbox will work with full functionality as it did when it was brand new.  It does not, so they breached the warranty.  I can return the Xbox, so it's not really too big a deal, but it is inconvenient.  They can test a dummy gold account just as easy as they can test to see if the Xbox turns on.

    Or if the entire console is banned, like they've been doing recently, you can tell them to just try to sign in. It'll immediately say the the console has been banned.

    that really sucks. i would say return it for a refund and just buy a new arcade. i deffently would not trust a used xbox seeing how there are a lot of problems with it.

    Console bans and account bans are separate. Your account should be fine.

    Your first problem was buying a used system. One that is notorious for breaking and being unreliable. You should get a new one to have that 3 year warranty,

    Just ask for another one? Or call up microsoft and tell them you bought this console used so wipe all the records of it or something.
     
    When i bought an Xbox360 used a couple years ago, I called them up and told them i bought it used and they renewed the 3 year warranty for me.

    I wouldn't blame Gamestop, so much as the people who are selling them.
    But hopefully in the future they can check for this sort of thing, and just not accept them from people.

    Well if you buy a Nintendo system used you have a chance of getting the previous owner's games, since it's tied to system and not to a user!

    At least when I worked for Gamestop, we had no way of checking whether a console had been banned, since we had no actual Internet connection in the store. All we could do was check if it read discs properly and wasn't modded or anything.
