 Be aware that as of this writing I am yet to play the following games which from the information I have received may make it into this list once played.
 
Uncharted 2- Not my kettle of fish but people are pushing this game on me big time.
 The last time a game was pushed on me was mgs4 which became my 08 game of the year.

The following games I am yet to play and have no intention of playing any time soon.
Dragon age origins
Infamous
Borderlands
Brutal Legend

 
13) Saboteur- Assassins Creed in Nazi occupied France I’m so there. has issues but i could imagine a sequal being brilliant.
 
12) Monkey Island SE – Maybe I’m guided by nostalgia maybe it’s a fever dream but in 09 monkey island was great

11) Mx vs. ATV Reflex - Reflex made significant improvements to every aspect of last years untamed except for the in my mind most important part, the freeride environment are a major step down and the freestyle tricks suck. I still maintain the best FMX game was and still is Mx Superfly.
 
10) Halo: ODST - Co-Op saved this game. It really felt like a half job, Halo 3 in a new frock. But Co-Op was fun so it gets a place here.

9) Batman Arkam Asylum- I straight up don’t like Batman as a Character or beat 'em ups as games. but this game was extremely well executed and was alot more than the beat "em up it looked on the surface

8) Shadow Complex - This has to be my biggest surprise of 09, it snuck up behind me and kicked me in the back of the head with a steel cap on. Platforming shooters are not my thing at all but shadow complex completely blew me away.

7) Battlefield 1943 - I thought I was past WW2 FPS’s but 1943 drug me back in with a vengeance, easily the best bang for your buck Game of 09.

6) Resident Evil 5 - I loved resident evil 4 so I was crazy Amped for RE5 initially I was disappointed until I started playing Co-Op which changed the tune of this game big time.

5) UFC Undisputed 2009 - Smashing peoples faces in never gets old and Ufc09 does it great.

4) Left for Dead 2 - Yet to play a lot of L4D2 but I played enough to know its more L4D which is all I want from it

3) Forza 3 - I Loved Forza 2 and Forza 3 takes all the right steps forward.
My biggest gripe with Forza 3 is the utterly flawed drag racing mode which I was greatly excited for in the games lead up.
 
 2) Assains Creed 2 - I liked the first game a lot. and this sequel improves in every way easily the second best game from 09 i have played so far.

AND THE WINNER IS ….

1)  MODERN WARFARE 2 (not really a surprise is it) - MW2 was by miles my most anticipated game of 09 and it not only met expectations it blew them away.

I really suggest giving infamous and Borderlands a try. dragon age was good, but you really have to be an RPG fan to like it. Brutal Legend was meh.

I kind of do the same thing, except instead of podcasts whenever I get new music I listen to it while playing Forza.

@Cirdain: you can clearly see I'm not one of those MW2 & nothing else people. I do however think that game is fantastic, more so for spec ops and single player. I actually preferred the multilayer in mw1 as it had better maps and fewer killstreak rewards.

I can see why people liked Forza 3.  With the absence of Gran Turismo series, it fills the void.  But for me, it was lackluster.  I didn't feel the "rush" and intensity like I did with Gran Turismo.  Yes, even for  PS2 game, it outshines Forza 3 easily.  Forza 3 felt dull and mundane.  No real excitment or fun.  When people complain that racing simulation games are boring, Forza 3 really highlights why people shun this great genre in the first place.  Verdict - Gran Turismo needs an official release date.  Fast. 
 
Halo ODST.  I love Halo 3.  I get that nostalgic feeling everytime I play through the campaign mode.  It was epic.  Halo ODST on the other hand, felt more like a "standalone" expansion pack.  You catch my drift right?  Expansion packs aren't standalone..  It was short, lackluster in visuals, level design was debateable, but it does provide a nice side story to the Halo Franchise.  I just wish it was longer, with more cutscenes that explain more of the Halo Story.  Good game, but not top 10 worthy.   
 
Batman Arkham Asylum.  Great pick.  Easily one of the most overlooked games, especially if you're not a Batman, DC Universe fan.  This game boasts one of the best combat mechanics in any videogame to date.  Graphics are sharp and top-notch.  Voice acting shines, overshadowing any old-school Batman Flick.  If you haven't played Batman AA, you should check it out now. 
 
Call of Duty: Modern Warfare 2.  Solid follow-up to Call of Duty 4: Modern Warfare.  It stepped into "movie" territory, providing some of the most engaging and energy-filled sequences and cutscenes, meshed into smooth and frantic gameplay.  It clearly lacks that nostalgic feeling in had in COD4, but to its credit, it does what it does very well.  Spec-ops mode is a PLUS.  Great game.   Too many haters. 
 
Infamous and Dragon Age: Origins.  You need to play these games.  DAO especially.  BioWare does it again.  All I can say in short, that it is epic.  inFamous, a sandbox game, mixed with superhuman fray.  Cole, your main protagonist is like your everyday comic book superhero.  The twist is, you can play hero, or anti-hero.  Choose to go the good or evil route, and you will be rewarded with unique powers.  For a sandbox game, with a large world, it runs smooth.  Using your superhuman powers is brutally satisfying.  What stood out the most were the controls.  It's smooth.  REAL smooth.  Climbing onto objects, buildings, climbing, swinging, is fluid.  Assassin's Creed 2 fluid.  A must-play.   
 
Uncharted 2.  This game isn't just filled with hype and admiration.  It clearly deserves all the attention and praise its been getting.  There is no doubt Uncharted 2 is the clear winner for Game of the Year.  It does everything right.  Cinematic presentation rivals that of Hollywood movies.  Voice acting is superb.  Graphics are insane, detailed to the brim.  This game looks sharp, clear, no jaggies, or unsightly fugly wugglies on screen.  Gameplay is dynamic.  Environments and level design is implemented to increase more dynamic gameplay.  So it's not just running around shooting at enemies (although this game has A LOT of it).  There are level design choices that blew me away in UC2.  Like the train level, and the... I'll let you play the game for yourself.  Needless to say, Uncharted 2, reinvents itself, and continues to innovate the gaming industry with its outstanding technology and beautiful presentation.  It would have to be my pick for Game of the Year.   
 
Killzone 2.  Uncharted 2's rival in technical prowess.  Killzone 2 is a beautiful looking game.  Its TECH stands out the most.  Although it doesn't play better than COD:MW2's gunplay, it does many other things right.  I think most people will agree with me that KZ2 is pure eye candy.  It has weight, polish, and it's the juggernaut of 2009. 
 
Left 4 Dead 2.  I agree with you perfectly.  Just MORE of L4D, with melee weapons and chainsaw!  If this game came out in 2008, it would have been the year of the CHAINSAW.  Resistance 2 with its chainsaw like blade weapon, Gears of War 2, and L4D2's chainsaw hacking fun.  Well, too bad, it came out in 2009.  No matter, it brings back the same good ole action zombie fest that is Left 4 Dead.  Dont fix what isn't broken. 
 
Resident Evil 5.  I knew eventually that capcom would have to take its franchise into a different direction.  RE4 and 5 became much needed action games.  Sure, it was controversial at first, due to its action-esque gameplay.  RE5 grows on you, and it provides a lot of replayability due to its co-op campaign functionality.  Graphics are beautiful, gameplay is great, but I would have liked other design choices.  Solid Resident Evil game.   

Assassin's Creed 2.  Ubisoft hasn't release a great game in a LONG time.  Ubisoft to me is a huge developer and company but at the end of the day, they just rehash games over and over.  On top of that, most, if not all their games are repetitve and dull.  They squeeze too much out of one franchise - namely Prince of Persia, Tom Clancy games, especially Rainbow Six.  Ghost Recon's first was revolutionary, but the sequels took away any nostalgic feeling the first one had left.  Assassin's Creed 1 was repetitive at its finest.  The core game had revolutionary gameplay.  You could climb just about anything with so much flow.  Combat was satisfying and it had weight to it.  But the story, and missions were terrible to say the least.  Sitting through those darn speeches right before you assasinate your target was disastrous.  The story was okay, but it was uneven, and confusing.  So now came Assassin's Creed 2.  A much better game in every aspect.  Better protagonist, better story, better gameplay, better level designs, and better missions.  The story this time around was perfect.  There are a ton more cutscenes that develop the characters and takes you through the story.  The  new main protagonist is likeable this time around and there were some fun bits that gave AC2 the much needed personality.  If Uncharted 2 didn't come out in 2009, I would have picked Assassin's Creed 2 for Game of the Year.  It clearly deserved it.  And let it be a lesson learned for Ubisoft.. not that they care.. heh heh.. They need to take more time to polish their games like they did with Assassin's Creed 2.    I'm predicting an upset with Splinter Cell: Conviction though.  Promises broken, once again.

I'd really suggest playing more PSN, XBLA or Xbox/steam Indie games. There have been some real gems in there Arkedo #3 Pixel being my favorite of last year, and it only cost me about 2 quid.

 I'm waiting till I get a few weeks off work in may to play uncharted and dragon age. I'm quite excite to play uncharted as I've seen my fair share of the game already. 
 
I may  get to Infamous. I'm a little sandboxed out at the moment, having just completed sabotour and saints row 2 in the past couple of weeks.

I played killzone 2 to completion, as well as dabbling in the multipayer and it straight up didn't strike a positive cord with me , further more it made my list of disappointing games of 09.

I play a great deal of indie and xbla games.  My favorites being audiosurf and altitude, the former gets played every time I acquire new music.
 
 
I will check out akido #3 pixel.

An amazing unrealized RPG by Phirana bytes. (PC version is only good tho)

4. Batman: Arkham Asylum

Great game for Batman fans and everyone else as well.

5. Runes of Magic

A free WOW clone.. what more do you want?

6. Battlefield Heroes

Great free MMO with micro-transactions. Flying airplanes and crashing them headon with enemies was my fav thing to do.

7. Braid

Fun platforming game, with great gameplay mechanics and innovation.

8. Burnout Paradise

Fast and fun Burnout returns, this time in an open world environment. Got tiring fast, but was fun till it lasted.

9. Trine

 
10. Assassin's Creed II

I haven't played it yet, but I went crazy about the first one. So I'm pretty sure I would have loved this one too.

I am yet to play Machinarium or Trine however i do have the demo's for both downloaded on steam and will get to them.
The Saboteur was certainly a guilty pleasure for me also. nothing like killing virtual Nazi's except possibly real ones.  Silent pistol+Double Barrel+Nazis= Awesome.
 Borderlands:  I'm holding off on this untill I have completed  a number of games I have piling up (mass effect 2 for example), also I'm waiting for one of my com padres to be free to play through with me co-op. Do you think its worth playing through solo? or should I wait?

I've never even her someone mention risen let alone a opinion as to weather its good or not.  not to mention that i'd 100% rather play a rpg on a console. couch= 60"= better than chair+22"
 
I have less then zero intrest in a WOW clone. are the graphics better than WOW? or better yet less Cartoonie?
 
1943- was a better package then heroes. although heroes is quite a good alternative.

As for Runes of Magic and BF: heroes, They were both average games, but since last year was my final year in school, I didn't get much time to play many games. That's how they made the list.
Yeah the graphics of RoM ARE better, you can check them out

@The_Infamous_C4: Umm thinking back I didn't really like borderlands that much. I just thought it was slightly better than MW2 so I put it infront.
But it is many peoples thing and does end being a game when you hit the max level. Oh I remember, I am drawn in for when you shoot something numbers pop of their head. I was fun though and high level people have a bunch of low level guns which they just give to the lower levels.
 
P.S. Just watched Clash of the Titans with my dad, don't watch clash of the titans. It's really bad.

Played uncharted 1 and 2 recently.
Uncharted 2 would have made second on my list bumping everything else up.
 
Also I Played Dragon Age Origins and did not like it.

I'm playing it right now and I truly believe that, if it was given to a developer other than Pandemic, it could make a really amazing sequel. If they just tweaked the shooting some, altered some controls and updated the graphics it would be a truly amazing game. That said, I already prefer The Saboteur over GTA IV, which was proclaimed to be a much better game. I disagree.
