If you don't have the right to distribute something, then you legally can't distribute it, even if the owner/rights-holder isn't distributing it in any way.

As far as I know, anyway, I'm not a copyright lawyer so I don't know the nuances of the situation. There's plenty of abandonware hanging around on the internet, research the legality of uploading/downloading that stuff and you'll be closer to your answer.
