The judgement came down today on an Osaka man accused of selling copied DS games, Jiji News reports. Kyoto district court judge Junichi Tochigi found 38-year-old Yoshiaki Asagiri guilty of copyright violations and ordered 2 years 6 months jail time, a fine of ¥2 million, and supplementary penalties of ¥7,135,450.
The fees were in line with those originally sought by prosecutors, but the jail time was lower than the requested 4 years 6 months.
Said Tochigi, "This crime is an insult to the efforts of the rights holders who spent great amounts in the production of the games. It's clear that the rights holders suffered great losses."
According to the judgment, Asagiri's violations included working with a female acquaintance and others to create a website which allowed for the download of copied game data. This was between July and August of last year and resulted in downloads by an unspecified number of people.

Sounds like a steap penalty even if it wasn't what the lawyers were looking for. Hopefully lesson learned hey.

It is, especially given the fact there is no specified number of downloads, it seems very severe given that.

The Japanese are coming down really hard on videogame privacy now, and Nintendo are largely responsible for that. In recent months they've been very aggressive in stamping it out, both in the courts and out.

Good for them I say. I don't subscribe to the theory that making an example of people will deter others, but they should still show they ain't gonna take shit.

Clever of Nintendo to get the Japanese government to pay for anti-piracy measures instead of spending all that money they could of in R&D hardware level piracy protection.

But, the article says he's selling the copies, so maybe it was a pay site?  It's a pretty big step to deciding you're going to sell pirated goods.

I'm happy to see this happening, piracy is hurting the industry a lot, particularly the PC/DS/PSP.

Music has become a lot more difficult to pirate, due to the amount of people being fined ridiculous amounts of money over it, including very young people, who you'd typically expect to be let off a little more lightly.
Anybody who's stealing games the rest of us are paying for, should be punished as much as possible.
