Former Rockstar North President Leslie Benzies Sues for Unpaid Royalties; Rockstar Countersues

What once appeared to be a significant but not-acrimonious exit is apparently a great deal more complicated.

You may recall back in January of this year that Leslie Benzies, the former President of Grand Theft Auto developer Rockstar North, left after 15 years with the company. Benzies' departure was significant and, from the outside looking in, surprising. His fingerprints were on the majority of Rockstar's major projects, including every 3D entry in the Grand Theft Auto series. Reportedly, Benzies' exit came after a lengthy sabbatical, which began back in September of 2014. When Benzies' exit was confirmed via Rockstar, the company painted this as Benzies' decision. Now Benzies is challenging that assertion as part of a lawsuit announced today, in which the former producer is asking for $150 million in unpaid royalties.

According to the announcement, Benzies' sabbatical was part of a "lengthy deception" allegedly designed to freeze Benzies out of royalty payments. Back in 2008, when Take-Two announced a profit-sharing initiative for key members of the publisher's team, Benzies was the only one called out by name alongside the Houser brothers--ostensibly painting him on equal ground with the Housers--but details of the suit assert otherwise, and during the sabbatical period, Benzies stopped receiving payments altogether.

The announcement also alleges that Benzies was prevented from returning to work following his sabbatical, which runs counter to Rockstar's statement on his exit from the company.

“When attempting to resume his duties upon conclusion of his sabbatical on April 1, 2015, Mr. Benzies found himself unable to enter the Rockstar North office because his facilities access device had been deactivated. After being let inside by building security, Mr. Benzies was then ordered to leave by the Rockstar North office manager without reason.”

Take-Two, Rockstar, Rockstar North Ltd, Sam Houser and Dan Houser are all named in the suit, but special mention is made regarding "a lengthy deception by Sam Houser," who allegedly sent numerous emails to Benzies intended to reassure him of his security within the partnership, before ultimately exiling him following his extended absence.

For its part, Rockstar has already filed a countersuit, alleging that Benzies isn't owed any additional payments, citing a breach of contract. Rockstar claims that in March of 2015, Benzies sent an email demanding "exact financial parity with his co-Principals, prospectively and retroactively as of the Effective Date of the 2009 Royalty Plan," something Rockstar believes Benzies had no right to do, as per the terms of the profit sharing agreement.

The one thing both parties seem to agree on is that they had been involved in a mediation process prior to the dual lawsuit filings, one that ultimately proved unsuccessful. Benzies' legal team claims that Rockstar's statement on Benzies' exit back in January came during this mediation period, and was "out-of-bounds and inaccurate.”

It's too early to know exactly where these suits are headed, but the level of grievance being expressed here gives one the impression that a settlement isn't likely to be on the immediate horizon. @jayzilla: rockstar does give out massive bonuses to anyone willing to stick around after the product ships and you do get royalty checks (or st least used to).

Granted it's not millions, but for some (people who stick there) it's totally worth it.

Let me get the timeline straight.

April 28, 2014 last royalty payment

Sep. 1, 2014 on sabbatical

April 1, 2015 he tried to get back to work but is removed and then quit.

Jan. 12, 2016 News of his departure hit

Where is this 17 months sabbatical suppose to be?

I'm not a "bro" gamer who is a GTA, COD and sports fan, I promise - but for some reason I have an irrational love for the series, I love the shit out of it.

Hearing the turmoil worries me so, I'm already crushed at the lack of 1,2 or even 3 SP "expansions" to the GTAV map, which it could have easily accommodated. What now for GTA6?
I've seen multiple articles which seem to claim Leslie Benzies is the bees knees somehow, so knowing he won't be there, worries me significantly :(

Where is my GTAV SP expansions? What now for Rockstar? Only games which I can get ridiculously hyped for and still find they meet my expectations somehow.

In hindsight, this makes slightly more sense than him deciding to leave the company he made wildly successful for absolutely no reason whatsoever.

Also I am just utterly floored by how much that picture of him looks like an actual GTA character.

@rramo010: Fair all around. That being said Rockstar thrives on portraying the world as a cynical hole out of which nothing escapes except stories and people like this. Maybe they all drank a little bit too much of the koolaide and started living like the hateful assholes from the games.

@entireties: the numbers don't matter, it's about a corporation refusing to give an employee the compensation they were promised, that they are entitled to. The principle is same whether the employee in question is a blue collar worker or a millionaire executive, because no matter how easy it is for us to say "who cares? The guy already has more than enough money" there is always someone worse off who could say the same thing about us.

It's a lovely juicy story that makes it seem like Rockstar is run by either dodgy or nefarious management. Either way, it wouldn't be out of place as a storyline in one of their games.

Rich dudes squabbling over millions of dollars is about the least interesting thing I can think of. At least in the olden days they'd settle this kind of stuff in a badass manor, like a duel or sword fight.

No dog in this race. The glacial pace of development at that studio means more to me than this. Hell, the fact I don't have a new Bully or LA Noire is more important to me as a player. I don't care that they don't make those properties...someone should be doing it!

The amount of dodgy dealings, bullshit, and other nefarious things I've heard/seen/experienced while I was in the industry - this story is not a surprise in any way. It was interesting to hear on the Beastcast of his direct involvement with GTA Online. Now that has made the company an obscene amount of money, I'm sure that was the catalyst for his infinite sabbatical.

Popcorn at the ready for some juicy future stuff...

Well said, I never thought about it this way.

People should live up to their contracts. If they are not living up to the contract of a guy this high up who is likely to sue (as he has the money to do so) how much more likely are they to be screwing over the lower level workers who don't have the resources to take them to court?

All of this of course assumes they did not live up to their contract. They may very well have and this could just be a power play by an unhappy employee.

I can't say I am surprised. Not for this particular case, which I knew nothing until they started reporting it and talking in the podcast, but about Rockstar attitude. Every time they are in the public spotlight, I grew more and more convinced they are a sleazy bunch: suing employees over royalties, suing modders over licencing, suing the BBC for a less than glowning portrait...

Given the history of the company with the legal system, I can't not see the irony.
