To eat your roommates food. 
I know, I know. It's never "right" to do so. 
But he is never here, his peanut butter chocolate chip cookies have been in there forever, 2 packages! 
So I could just eat one...right?

Is his name on the food? 
 
It's the community/house fridge of all things too, you dont put things in there unless you dont care about the food.  If you did care you'd label your food or put it in a bar fridge in your room. 
 
Just eat the food and when he comes back, if he complains just say you through it out because you were cleaning the fridge and thought he was dead.

Just eat them all and get rid of the evidence.

If its something with multiple items, like cookies, and at least 1 is not eaten a day/2days its up for grabs. This may make me an unpopular asshole of a roommate but I wont be a hungry roommate.
