That is going to completely fuck with their sales figures and might end up being a reason it sells poorly in Europe. I'd rather wait a little longer.

Also, it isn't the fault of Monteiro, he hasn't done anything wrong here. Don't see why people are insulting him.
I wonder why this didn't come up before release, This sort of thing is one of many reasons that publishers have a Legal department, right?Because I'm pretty sure Double Fine doesn't have a department dedicated to obscure board games in PORTUGAL.
I live in Ireland and I for one am delighted that this vile video game wasn't allowed to impinge on my enjoyment of some Portuguese board game I have never heard of!

Why are people blaming the guy who holds the original trademark? If anything, blame the publisher for not doing their job and coming up with a proper alternate name ahead of time. This is game publishing 101 stuff here.
The Eurogamer reader "zabou" posted some very interesting information in the comment section of the Eurogamer article. It looks like Microsoft really didn't do their work:
"Apparently Mr. Monteiro created a board game in 2009 and registered the name TRENCH in 2009 in Europe and in Jun 2010 in US (not 2007 as said here). Since nobody said anything against it, it was approved in March 2011 for US,

He introduced his board game to the professional traders this year at the TOY FAIR 2011 in Nuremberg with some success (I suppose it’s an honest amount of time to release something especially for a small company as they seem to be).

What seems to have happened is that Microsoft/DF created a video game, decided to call it TRENCHED, announced it all over the world for the 22th of June 2011, but filled only on May 2011 to register the name, and when they finally discovered that they couldn’t use it, they decided to send it out just in US with the name “TRENCHED” (they probably think that the Portuguese won’t get them there) and are trying to find a solution for the European market.

To me it looks like Mr. Monteiro followed all the logical and legal procedures in the right order which is probably not the case for Microsoft/DF, and maybe that’s why they have been lying about the reason why they could not launch it in Europe on time.
Let’s see now how this will end. Will David defeat Goliath again, or will it be like Homer Simpsons VS. Bill Gates. Personally I will buy that “famous” board game ASAP."

Release as drenched in Europe, re-skin mech's and walking submarines. Problem solved and a hilarious inside joke will have been taken too far. Two birds, one stone.
Rename it to Foxhole and you're done!
Perhaps they can take solace in the fact that Lucha Fury was released on XBLA in Europe last week with no hassle to speak of.

*EDIT* Actually, how about calling the game "*****ed: European Extreme" and then bleep out all instances of the word "Trench" in the spoken dialogue?
