The problem I have with used games is not so much with 2 year old games like Deadly Premonition, but with games that just came out. Selling games that just came out at a $5 markdown and pocketing a massive profit margin, none of which goes to the people who made the game, is slimy to say the least. The out-of-print issue you raised is interesting, but as Shivoa mentioned above, largely solved by digital distribution. With digital distribution services like I imagine will be on the next generation of consoles, you can exactly match the demand for a title without having to worry about printing runs, etc. This should make the pricing structure more flexible as well.
As for the quality of a used DVD, that's always a concern. I think Amazon does a particularly good job with their used games. If used games are completely axed on the next generation of consoles, I will miss buying older used games that I might never have otherwise tried off of Amazon.
