$55 fine for wearing headphones while Driving. Bogus?

yeah... I got pulled over for listening to my iPod while I was driving.  This is my first offense... ever.  I thought that the guy would cut me some slack and send me off with a warning since it's my first offense and all but... he didn't. 
 
I was listening to the Bombcast btw.  I don't know if that justifies my actions.  What dyou guys (and gals) think? 
 
EDIT:  And I think I'll get an FM Radio Transmitter... apparently they're inexpensive.

Seriously guys. Arguing that this is bullshit because "you can listen to the radio as loud as you can" is retarded because you shouldn't be doing that either. It's almost like you'd eat toxic waste if THE MAN was not there to tell you it's a retarded idea.

@Detrian: I dont know about you, but I don't give a shit what the "Man" has to say about my safety.  This is a country based upon freedoms.  The freedom to decided how to live your life, so long as your decision does not impede the pursuit of happiness or safety of others.  if i want to fucking eat toxic waste, who the fuck is the man to say i cant.  its my body and my life and i'll live it how i please.   
 
With that said, those stupid enough to go eat toxic waste don't really deserve anybody's time of day to try and save.  Darwin had a damn good theory and the government seems to have forgotten it. 
 
 
Edit: also, as has been previous stated, the government has decided that one does not need the assistance of hearing in order to operate a motor vehicle.  As deaf people are allowed to drive. 
 
Edit 2: Apple ear-bud headphones are allowed in many states, in compliance with hands free phoning laws,  for in-car use. 
 
Also, to address court fees and costs.  If you just show up to court to argue your ticket and you have a good point, you dont' have to pay anything.  Even when you lose the argument, most judges (that i've witnessed in my midwestern state) will not assess you court fees for 5 minutes of talk.  The only time you have to pay serious money for court time is if you sue.

So last night, when I got to the park and ride after my commute, I still had my headphones on from listening while on the bus.  A really good song was on, and there's some delay between Flycast and my radio station.  So I finished listening to the song.  I wore headphones for about two blocks while driving.  And couldn't hear a thing outside my car, even with my window rolled down.  Although I already knew why it was an offense, after trying it for myself, yeah I can definitely see why this is ticketable.

Just so you know, in some places driving with music blaring is illegal. All military bases I have been to (when I was in the Army) had this law and you WOULD be ticketted if your broke it.
 
I was going to give my opinion of the OP, but I wont because it will come off as harsh to those who disagree. The last thing I want is to start a flame war. Just know that hampering your ability to drive with all your senses is and should be illegal.

No I can honestly say after driving for 7 years I have yet to use my horn unless it was in anger or frustration it has not been a factor in my driving experience I couldn't even tell you what the horn on my car sounds like.

That's great and all but "the government has decided that one does not need the assistance of hearing to operate a motor vehicle" is a bullshit fallacy since that's in place to prevent discrimination, not for safety. Not to mention that in some states deaf drivers ARE required to have special license plates indicating their disability or equipment that helps them be aware of their surroundings to drive around.

What if a distracted driver hits you, or a loved one?   Would that impede your pursuit of happiness?  Your words appear to suggest that our individual actions don't have spill-over effects that touch upon others.
 
On another note: Do you believe prostitution, gambling, and drugs should be legal too?

The ticket would have been justified if they were headphones built to block out noise from the outside.  If they are just lil' earbuds and you can hear outside noise fine, then that's OK.  Same as just having your music loud over the stereo.

But if evidence just doesn't exist that there is any correlation between "distracted" driving and fatalities --- evidence actually indicates the opposite --- then when do you start to ask why something is done?

I take it all you guys and girls giving the OP a bunch of shit for driving w/headphones on aren't hypocrites. You know, because none of you ever speed, roll through stops, go through yellow lights you could have made a stop at, eat while driving, answer the phone, change the radio station, look at your GPS, reach for something in the dashboard,  bag, floor of the passenger side or backseat, put on makeup, play loud music, drive while sleepy, drunk or stoned, check yourself out in the mirror, drive with a leg up, change lanes without signaling, or anything at all that would make it even the slightest bit more dangerous for others on the road. . .
 
Of course, when you do any of these things, it's because you can handle it and the regulations are too strict. Not because you put your own personal needs above the safety of others.
 
Yes, driving with headphones on isn't the safest thing to do and it's currently against the law but try not to be the stereotypical internet douche about your opinion. Unless you're just trying to draw attention to yourself in how funny you can be about being a dick. In which case. Good job troll.  Well done.

i find it stupid that they would do that. there are people out there that have big subs and amps in their cars that are loud. you can hear their *BOOM BOOM* all the way down the road. i just say that when i listen to music on mp3 player i put it on low so i can also hear what is going around me. i usually only use it when playing forza 3 because them music on there isn't loud enough. 
 
kind of stupid that it cost $55 for it. i didn't know you could get a ticket for it.

I knew this was a law, but never got it. Why the hell do you need to hear things while driving? 
anyway, I got pulled over for speeding, but rather than just having to pay the fine I have to show up in court for some reason...hrmmmm. Oh well, since the cops don't even show up half the time I might get off with nothing.

There are better ways to do that. Like pulling an elderly gentleman someone over for having a handicap placard hanging on his rearview mirror for "obstruction of view" or pulling a newly driving, supervised teenager over for going 3 mph over the limit and ticketing both his parent and him.

@Kyreo: Those are not bullshit regulations. Wearing a helmet while biking is smart. Joggers wearing reflective clothing or vests is also smart. The reflective clothing or vests is mainly used at night so joggers are easier to see. 
 
Wearing headphones while driving and listening to music very loud while driving is dangerous. Mainly because it hinders your hearing while driving.

Totally justified. It has been a law for a long time man. Listening to a stereo is one thing because it is ambient noise around you. You can still hear things. Placing headphones in your ears that DIRECTLY block your ear canal cancel out a lot more noise, especially ear buds. It sucks that you got a ticket, but it is your fault. When you are driving you are expected to be aware of your surroundings. I generally hear a police/fire truck/ambulance siren waaaaaay before I see it and it tips me off to watch for it. They probably couldn't care less if you can hear some dude laying on his horn because he thinks you accelerate to slowly off of a green light. They want you to be ready for government vehicles.

Driving while texting is pretty dangerous. It makes the driver not focus on the road and the driver should always focus on the road.  A couple of days ago my mother and I were almost in a car accident because some guy was texting with his phone instead of paying attention to the red light he ran through. Just because you can somehow focus on the road and text at the same time does not mean everyone can.

I enjoy reading the posts from people who do things that are illegal and get caught for it. Therefor they are usually reprimanded for it as the law dictates, of course this means there is something wrong with the system and they did nothing wrong.

I obviously didn't read the whole thing haha. I was trying to say that both texting and your ear-buds are stupid and extremely dangerous things to do while driving. Both are illegal to do and I wont feel sorry for anyone that gets a ticket doing it.

Is it justified? Probably not. I see it as the same as a dude with his radio blasting and as long as your not using noise canceling headphones I don't see a problem with it. It's just that it does look bad to a cop cause he just assumes that your being reckless thinking you can't hear whats around you.
