Games that get taken down from the Marketplace can't be regained?

I decided to round up every single title I've bought thus far on XBLA and download them all, just to get a sense of which games I have (and because I felt like filling up some room on that new HDD I bought.) Thing is, I've noticed that two of them are no longer available. I'm talking about Dash of Destruction and Robotron 2084. Now, Dash of Destruction, I can live without, especially since I didn't pay for it, but I did pay for Robotron and actually quite like the game. I had deleted it because I wanted to clean out my small HDD, but now I'm left with not being able to play the game, despite having put down 5 dollars for it.

Is there any way to download these games again? How do you feel about this. In my opinion, they should at least always keep paid content up there, for the simple reason that it should always be available to paying consumers.

Yeah it kind of sucks.  I think some of these are based on contracts with publishers.  But in some cases, I think Microsoft just feels like the server space could be used for something that sells better.  In either case, it sucks for the player.

What about your download history?  Usually the stuff that isn't buyable can still be redownloaded if you bought it.

Really? I had never even noticed there was a comprehensive download history before. Guess there are still things I've yet to find out about my consoles. Thanks for the help, people!
