Sony Issues Official Statement About Hacked PS3s

In short: don't hack your PS3. Just don't!

Don't copy that flopp--er, hack that PlayStation!
Don't copy that flopp--er, hack that PlayStation!
If you’ve been reading the tech side of the web since CES, then you already know about the PS3 root key drama. A hacker that goes by the name of “Geohot” exposed the key in early January, basically allowing pirates and homebrew creators to run unsanctioned software on the console, an ability that certainly lends itself to certain nefarious ends. Yesterday, Sony issued an official warning to those who may be fiddling around with rooted consoles, stating that PlayStation Network access will be revoked if the manufacturer spots someone running a hacked console.

Here’s that statement, which was posted on the PlayStation blog:

Notice: Unauthorized circumvention devices for the PlayStation 3 system have been recently released by hackers. These devices permit the use of unauthorized or pirated software. Use of such devices or software violates the terms of the “System Software License Agreement for the PlayStation 3 System” and the “Terms of Services and User Agreement” for the PlayStation Network/Qriocity and its Community Code of Conduct provisions. Violation of the System Software Licence Agreement for the PlayStation 3 System invalidates the consumer guarantee for that system. In addition, copying or playing pirated software is a violation of International Copyright Laws. Consumers using circumvention devices or running unauthorized or pirated software will have access to the PlayStation Network and access to Qriocity services through PlayStation 3 system terminated permanently.

== TEASER ==This isn’t really shocking stuff. Microsoft doesn’t allow hacked consoles on its networks either, but this is the first official warning that I’ve seen from Sony, who is currently battling it out in court with Geohot over the key.

If you’ve got a hacked console and don’t want to be banned, Sony says the way to avoid problems is to “remove all circumvention devices and delete all unauthorized or pirated software” from your PS3. Or you could, simply, stay off PSN--that’d probably do the trick, too.

Today, Sony is giving hackers a second chance, just in case this warning hasn't reached them. PS3-Hacks reports that users signing on with hacked consoles are immediately receiving this message:

Important: Access to the PlayStation(R)Network and Access to Qriocity(TM) Services Notice

Unauthorized circumvention devices for PlayStation(R)3 system have been recently released by hackers for the PlayStation(R)3 system. These devices permit the use of unauthorized or pirated software.

Use of such devices or software violates the terms of your “System Software License Agreement for the PlayStation(R)3 System” and the “Terms of Services and User Agreement” for the PlayStation(R)Network/Qriocity(TM) and its Community Code of Conduct provisions. In addition, copying or playing pirated software is a violation of International Copyright Laws.

A circumvention device and/or unauthorized or pirated software currently resides on your PlayStation(R)3 system.

Immediately cease use and remove all circumvention devices and delete all unauthorized or pirated software from your PlayStation(R)3 system. Failure to do so will result in termination of your access to PlayStation(R) Network and access to Qriocity(TM) services through your PlayStation(R)3 system.

The question remains if Sony is just banning PSN accounts, or the actual consoles used to sign on. I assume we'll find out in a few days as Sony ramps up its protection of its network's integrity.

@Kyle:  They can, the newest Firmware runs certain checks when signing into PSN (before you "connect") which also let it run whatever code it wants pretty much, so they can use this to detect whatever a user has on their PS3. And without the newest Firmware you cannot get on PSN (at least at the moment, who knows in the future).

It sounds like they'll just block the consoles the same as Microsoft does. "
Failure to do so will result in termination of your access to PlayStation(R) Network and access to Qriocity(TM) services through your PlayStation(R)3 system. " Doesn't sound like they'll be going after PSN accounts.

Is it really a smart idea to advertise the fact that your system can now be hacked to play pirate games?  Why not just run a TV campaign while you're at it.

I'm glad to see they at least have some sort of protective measures in place.

I haven't been keeping up on the homebrew scene, but the PS3 has the potential to become the best home theater box available. Between Blu-Ray, the ability to play any format without transcoding, streaming internet video, bluetooth support, etc. a hacked PS3 would be worth it even if you couldn't connect to PSN. Hell, get a second one just for media. I just wish it had a built in IR receiver for my Harmony remote.

edit: Oh, and I obviously don't care if people hack their consoles to do stuff like that. It's your machine, do what you want with it. That in no way is me being accepting of piracy. I'm also against taking hacked consoles onto PSN. It may be your console, but it's Sony's service, and a hacked console that can easily cheat ruins things for everyone.

They could easily ban them by MAC addresses of the system and they should if that's what they feel they need to do. It's the best way to keep them off the system.

That being said, we'll see how well this goes for them. They should have been more awake to their hackers problems YEARS ago. This is not something new for sony, people have been hacking Playstations since the first playstation came out.

They are only now taking notice apparently since so much rides on being online capable these days.

All I can say to them is good luck with that.

You are entirely correct in this assumption. Since this news story has been posted, the root key usage has increased by one-hundred ten percent.

Fair enough, pirating games is stealing, and given how many people in the industry are being laid off (even at mammoth Activision) there is no way of claiming it hurts no-one.

Also, I love how they repeatedly refer to Qriocity (took 3 tries to spell that right) -- like these hackers would actually use Qriocity (only two goes that time)

I modded my original Xbox. It was the best set top media player available without going up to a full home theater PC. When the xbox optical drive started failing I was able to put all of my games on the hard drive. When the drive finally died completely I didn't lose anything or have to pay to get it repaired/replaced.

If you install custom firmware, you're giving a huge amount of control over your system and information over to the hackers. They could, for example, steal your credit card information if it's stored on your account.

PC market has dried up a lot because of the costs and the time it takes to make a PC game.  I could go deeper into it but I don't believe there is the need.  The consoles stole the PC thunder pretty much.

good, i think they just should advertise as not using the hack. they're advertising for pirating the games. they should start console banning the people that hacked their ps3. pretty crazy stuff in the world of video games.

i think that every console now i starting to get hacked. people are going to find another way around getting past stuff.

I'm in complete agreement with you. The user buys the device, it is theirs to do with as they desire. Sony provides PSN not the other way around. They have all the rights in the world to limit the access as they see fit. If people want to make homebrew games and media centers and what not go for it, just don't expect to get access to the PSN stuff. Besides, all those people buying another PS3 (one for hack and one for legit access) just means an extra sale for Sony.

It's a shame that 1 guy had the determination to potentialy terminate Sonys success.
This could have such ripple effects that Sony stops making consoles, people lose their jobs and we gamers get less choice and more stale games built on the 'itll sell formula' and nothing original or risk taking.
Screw you Geohot.

The 360 and wii have been hacked almost since launch.

I am not advocating piracy but it hasn't killed those two consoles.

I think piracy damaged the PC and PSP - but it was also like, not releasing good games.

this appeals to me also. There is no bullshit, you are not pirating, just simply adapting the hardware to another use like home theator. Were not ppl. in thre sciences already stringing Ps3's together for some kind of computing advantage?, Gawd whats wrong with that? If it is really that good for it, right on. If you are pirating, fuck you. Pirates have done their damage in the best gaming realm possible, the Pc. Except for the cost of these machines, I'm pretty bitter about it.

Despite the millions of console players who would vehemently proclaim that PC gaming is dead, the numbers just don’t support that conclusion. The analyst firm Forecasting and Analyzing Digital Entertainment estimated Steam’s sales for 2010, which they claim for the first time almost topped $1B.

The grand total ended up being $970M with $230M in sales in December alone. These numbers are impressive, but it should be noted that it neither counts other portals of digital distribution for games (though Steam does have about 70% of that market) nor brick and mortar sales of games, meaning that the PC market is even bigger still.

I have no problem with Sony banning people for modding or hacking their PS3 - the PSN network is a service they provide at their own discretion. I've also got no problem with them dropping support for customers who do mod their PS3 or hack it. Again, that's a service they provide at their discretion. You don't have a "right" to PSN or Customer Support if you violate their terms of use.

I also don't have a problem if Sony bans or sues people who try to pirate games. It's their software, they have a right to prevent it from being copied.

Where I draw the line is when Sony tries to sue the modders like Hotz. Modding isn't illegal - don't you own the PS3 console you paid for? Isn't every single plastic/silicon/metal BIT of it yours? You don't have the right to reproduce it, but you do own THAT particular console. So shouldn't you have the right to do ANYTHING you want to it?

You don't have the right to do anything you want WITH it (like kill a guy by bashing him over the head with a PS3, or play Pirated games), but you DO have a right to do anything TO IT. If I wanted to, I have a right to take a baseball bat to my PS3. I'm not renting it from Sony, I bought it outright. The processor, the chips, all that stuff, it's mine. Not the design, but the physical stuff in the PS3 is MINE and MINE alone.

So I have the right to mod my PS3 to make it run whatever code I wish. I don't have the right to pirate any game at all, I don't have the right to hack the PSN - but I do have the right to change my console in any way I wish. Of course, if you use a modded PS3 for illegal activities, it is illegal. But the process of Modding itself is not illegal. Just like owning a pair of bolt cutters doesn't make you a robber, modding your PS3 doesn't make you a Pirate - Pirating GAMES makes you a pirate. Not modding a console.

Sony doesn't have the right to sue Hotz. Sue the pirates who are actually copying the data off the discs? GO for it. Sue the modder? No. If apple can't sue people for jailbreaking their iPhone (and believe me, they tried), Sony won't be able to bring down Hotz.

" The PC games market died cuz of piracy. Lets not kill the console market too.   "

I'm soooo happy that the PS3 has been cracked. Now maybe piracy will kill the console market, and PC gaming can return to a new golden age!

It's about that time in the consoles life cycle where even simple business machines can meet or exceed the graphical quality of most consoles. OUR TIME IS NOW!!! bwahaahaaha!!

" Yeah, that's IF Sony can even detect hacked consoles on PSN.... "
I don't think they can. Microsoft checks  system performance to see if there is a mod chip. They also see if you're running game ahead of time.
Sony's problem is with the code. There is really no way Sony can check as far as I know. I would assess this as a deterrent for piracy on the PS3.

" Fair enough, pirating games is stealing, and given how many people in the industry are being laid off (even at mammoth Activision) there is no way of claiming it hurts no-one.  Also, I love how they repeatedly refer to Qriocity (took 3 tries to spell that right) -- like these hackers would actually use Qriocity (only two goes that time) "
Activision didn't have to fire anyone because of piracy. It's because they drove tony hawk and the hero franchise into the ground and people stopped buying them.
