I hope this case gets thrown out of court.
Does this woman have a valid reason for suing?
Yea I heard this on the radio the other day lol. Basically she is saying Rogers ruined her life and they owe her money for exposing her. HAHAHAHAHAHAHAHAHAHAHAHAAHAHAHAHAHAHAHAHAHAHAHAHAH
Emotional damage claims typically don't fly in Canadian law.claim emotional damages. "
The big hurdle in this case is lack of sympathy. You might be able to get a company to pay you off to keep bad press at bay, but most people will probably read this story, say "fuck that dumb bitch" and move on. Leaving her without the public support that could help net her some cash.
...guess it depends on the contract tho. It might be "her" phone but there's a good chance it'd be attached to an account that they would both have permission to edit the billing details of.
" I dunno Canadian law but with US law, there might be a slim chance she can sue as a minor tort, and claim emotional damages. "She'd get laughed out of court, unless she can prove that she did not give them permission to merge the phone bills (if they were on seperate accounts.)
Then she'd need to prove causation, which would be difficult because she stitched herself up on that one.
In order to use a tort you need to come with 'clean hands' as they say. She breached a contract, so she would have no avenue of recompense.
At least thats how it is in the UK.
the only problem i see with this is if he was autherised to make a change like that on her account. If she was the only person able to make changes to her account it should not have happened
Dumb bitch and she should be sued for everything she owns for putting the blame on someone else.
On a legal stand point though; if they don't have her signature to prove of her approval of merging the bills, she COULD win... unless the husband owned and signed both phone plans and then offered one of them to the mrs (sorry, miss).
If it weren't for the dumb bitch's attorney the case would be completely frivolous. Breach of contract and invasion of privacy are actually arguable if there were really two separate accounts being paid under different names, but blaming the phone company for ruining her marriage? Surprise bitch, adultery stinks, and as she said herself, her husband isn't stupid. Neither is the court, so I expect the case will just get thrown out if she can't provide evidence of her charges.
I can't help but feel for the kids, though. The guy should have filed for custody, or something instead of just walking out. He's probably suing for divorce as we speak, if he's smart.
I dont know the law in Canada, but I would say yes, she can sue. The husband had no legal right to change her account unless they were both on the bill, or the bill was being paid by a card that only had his name on it. Even then he might not have the right to change it. If you ever had to try and pay a bill without having your account #, or your name is not on the account you are going to have a hard time getting them to accept your money. Its crazy, Im like I want to pay this bill! TAKE MY MONEY! Cant do that until you prove who you are blah blah.
