Is it really wise to incite civil war or threaten the President?

Mississippi Tea Party Chairman Roy Nicholson posted a statement at his group’s website on Friday proclaiming that “the US Supreme Court has joined with the Executive and Legislative branches of the federal government in abandoning the Constitution, the Rule of Law, and with that ruling abandoned the People.”

“The all out oppression of all people has begun,” Nicholson continued. “In such cases submission is treason. Treason against the Constitution and the valid legitimate government of the nation to which we have pledged our allegiance for years. To resist by all means that are right in the eyes of God is not rebellion or insurrection, it is patriotic resistance to invasion. . . . May godly courageous leaders rise up in His wisdom and power to lead us in displacing the criminal invaders.”

Firstly, insurrection? Civil War? The Supreme Court ruled it constitutional, but hey, let's not support the Supreme Court if it doesn't suit us.

It's incendiary speech, but it is largely protected by the First Amendment. If this sort of language was in a pamphlet, it would be protected speech. If this guy was giving a speech to a group of people and encouraging them to commit illegal acts, he could be found guilty of solicitation. Overall though, beyond the "save America, shoot a Muslim" thing, he is largely advising people to rebel by legal means. I certainly don't agree with his opinions and think he could use an editor, but he isn't technically doing anything wrong.

As for the future of American society, I think things will improve. It just happens to be very partisan right now. The rights of the federal government, the state government, and the individual are in flux at the moment due to the attempted reforms of the financial and medical systems. The important thing is to stay involved where you can and advocate for what you believe is right. Think of it as your...vision of America.

That being said I wish fiscal conservatives would force religious fundamentalists out of the party so that they could form their own pointless party, and we could go back to having rational discussions about the government and it's place in the economy

But the Declaration of Independence has absolutely no legal authority. It's pretty damn important to American history, but it's not a plan for government that people had to agree to (like the Constitution or the Bill of Rights); it's a list of reasons why Britain could go fuck itself.

That's very true that it was never intended as a constitutional document, but the opening statement:

When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

...states clearly that they believed any people group should be capable and willing to throw off an oppressive governing body, regardless of the nation or class of system.

But just so I'm not associated with the OP's quote, I'm not advocating revolt, nor am I about to take up arms against my beloved country. I think America will collapse for the same reasons as the Roman Empire long before revolt is even remotely necessary.

I'm not one of those, "The Founding Father's said it, and what they wanted has to remain!," kind of people, as I believe they designed a system that should adapt to the desires of the people (as a democratic republic should). But the FF unintentionally shot the country in the foot when they instituted the Supreme Court. A single judicial body, immutable by the the nation's people, chosen by and answerable to the president alone. Nine citizens beneath one, the one removable, the nine essentially not. 1

I believe there are a lot of cases in which the desires of today's citizens should overrule the founders' intentions. But I think any ruling expressly forbidding what was expressly encouraged by the founders means something is very wrong with either the founders' intentions or the modern ruling.

I can't find the original thread, but I'll quote below what I stated there:
