$55 fine for wearing headphones while Driving. Bogus?

yeah... I got pulled over for listening to my iPod while I was driving.  This is my first offense... ever.  I thought that the guy would cut me some slack and send me off with a warning since it's my first offense and all but... he didn't.

I was listening to the Bombcast btw.  I don't know if that justifies my actions.  What dyou guys (and gals) think?

EDIT:  And I think I'll get an FM Radio Transmitter... apparently they're inexpensive.

Why is your ipod not hooked to your car stereo so you can listen through that? Obviously your fault :)

I don't see how headphones are that different from a car stereo that's turned way up, to be honest.  A lot of people do that, why are headphones being targeted?

FM transmitters aren't that fancy, or expensive.

Wtf? I don't know what I am more shocked by, the fact that you got ticketed, or the fact that people here feel you deserved it.

I have never heard of this offense. If you can use a phone while you drive, they suggest hands free methods. Besides a bluetooth base and speakerphone, any other option will include something being in your ear. Also, playing music loudly isn't an offense is it? This makes no sense. I too use my ipod at times, specifically for the bombcast. My car doesn't have an aux jack and all the radio transmitters I used are shit.

The fact that he ticketed you when it is your first offense is also quite strange. I feel for you OP.

It is a violation to have your stereo to loud as well. Most people dont have their music so loud so that they cant hear cars beeping or sirens. Headphones can block out that noise much easier, which is why an offense as well.

Putting something in your ear canal is different than loud external sound, I'd think.  Come on guys, take driving seriously, so many don't already.

Well... I live on a Military Base and the safety regulations are strict as fuck.  All bikers MUST wear a Helmet, Joggers MUST wear reflective clothing or vests, music volumes are regulated based upon how clearly someone can hear you at a certain distance...

I can't imagine there are bullshit regulations like this in the civilian world.

Who the hell drives with headphones on?

That is dangerous as all fuck.

In my Mercedes, my iPhone automatically connects into the dock so I can just stream the movies, songs, and other media from my car's dashboard.  Look into buying a dock for your car or something...but damn man, please tell me you don't live in the North Eastern of USA.  Why do you listen to headphones?!

@arab_prince: A lot of places have outlawed the use of phones while operating a motor vehicle.

I don't know. I think it's intuitively a bad idea to wear headphones while driving. You're seriously hindering your ability to hear, which can make a substantial difference in a snap-judgment situation, should it ever occur. And the "basically the same as playing a stereo at a high volume argument" cuts both ways, because that too is a bad idea, lessening your ability to react or judge with total confidence your relative environment.

Headsets generally only go in one ear, and a phone conversation is on a much lower volume level than something like music. All told, you hear a lot more and are thus a lot safer than when using headphones.

Sucks that you got a ticket, OP, but the cop was entirely justified in giving one (and as someone else already pointed out, $55 IS letting you off easy). You should get an FM transmitter or something similar. I think I got mine for around $20 at Radio Shack, so they're far from expensive. Mine plugs into my cigarette lighter.

You don't directly block your ears with stereos.

Also I'm sure they would also crack down on you for having your stereo on full.

Then just buy a cheap one from Walmart for 10 bucks or something.  They plug into the cigarette slot.  Yo, that is fucking dangerous as all fuck and you can get a big ass fine if you did that in the city up here in the east.

Its an offense in pretty much every country in the world. I think the reason why you still got the ticket was because what you were doing is potentially quite dangerous, and has serous implications.

It is an offense, I see people with them in their ears while driving all the time, its dangerous. I don't want to be on the road with people like that. They are a distraction, with them on your main focus is your hearing, you need to be able to hear, noises around you. Just because people have their music up loud doesn't mean thats jusified either.

Also, you don't need a fancy system in your car. just a car adapter that hooks into your car jack and turn your system to AUX.

With more technology available, there is more distractions on the road. On the bright side, It could be worse. At least you wern't texting on your phone whilst driving. That's worse.

It sounds weird to be illegal at first, but it makes sense. You don't block all external sound by listening to something in your headphones. Just use the external speakers or something.

Dude, there's no problem with texting.  I do it all the time, and when I'm in downtown...I can connect to Comcast over the city WiFi and I place my laptop on my lap while I drive.  It's safe if you know what you're doing and it's important when I have a law paper due that day and whatnot.  Plus my car automatically stops if I'm about to hit something, as I found out one night.

I've crashed a bike (the ones you pedal) on a sidewalk because I was using ear phones.
I barely even answer my headset while driving because of that. It'll mess you up.

I'm too cautious , but I was able to get a really cheap headset on EBay. 5 bucks, and it's not too shabby.

IDk, I learned that wearing headphones/earbuds while driving was not okay when I first started driving. It's in the learner's handbook. I don't know if it's a ticket-able offense everywhere, but it definitely is here and always has been.
You can plug your iPod into the car stereo easily enough. I have a tape player in my car only, but there are tape adapters you can get for like a dollar on Amazon.

In my state I believe it is legal to have one headphone in, but not both.  In other words, those blue tooth ear pieces that fit over one ear are legal to use while driving.   But, I personally don't use a cell while driving.  (Actually, I rarely even carry a cell.)

Of course, texting is much worse.  You get a guy who is driving 15 mph slower than everyone else or doesn't realize traffic has started moving and you just know it's going to be some douche texting.

@KaosAngel: Oh Yea that's DEFINITELY much safer. except not all cars have a magic instant car stopping device either. I have a microwave and a coffee brewer in mine, that I use while I'm driving. It's okay though because my car can drive itself.

I always write university essays on my laptop while driving though a residential estate at night at 80 MPH while playing on my DS on the side. Its safe if you know how.

@zityz: It's not magic and only works for city driving.  The GPS in the car knows when I'm in the city and the driver assist icon pops up, and knows when I'll be waiting for minutes on a light, and knows when to stop when I press on the gas.  >.>

That's not magic, and it's safer because I know when to look back up at my dash to make sure everything is okay.  I'm well aware of my area and know not to abuse it, plus when I text on the highway, I put my phone up to my wheel so I'm always looking.  I'm no teenage punk that takes safety for granted.

A) Texting while driving is statistically as bad or worse (I can't remember off the top of my head, I had to attend some seminar on this) than drunk driving.
B) Other cars don't have the magic stopping device, when they're hitting you.

Anyway, you can actually listen to an iPod with one earbud in. Little known fact.

I'll spare you the "don't wear headphones while driving, idiot" talk but you're lucky, $55 is nothing. Friend got $350 fine for talking on his cell phone, so just obey the rules and don't complain when you get caught breaking them. We need more safe drivers out there.
