$55 fine for wearing headphones while Driving. Bogus?

yeah... I got pulled over for listening to my iPod while I was driving.  This is my first offense... ever.  I thought that the guy would cut me some slack and send me off with a warning since it's my first offense and all but... he didn't. 
 
I was listening to the Bombcast btw.  I don't know if that justifies my actions.  What dyou guys (and gals) think? 
 
EDIT:  And I think I'll get an FM Radio Transmitter... apparently they're inexpensive.

I always write university essays on my laptop while driving though a residential estate at night at 80 MPH while playing on my DS on the side. Its safe if you know how. "
I sometimes wear a blindfold while I drive so that I can practice some sweet magic tricks on the way to work in my F1 car.  Did I mention that I work for Delta Force by the way?  The elite driving skills they taught me mean that it's actually perfectly safe.  I'm probably safer than a regular driver who isn't doing any magic tricks tbh.

I'm surprised nobody knows the real reason you aren't supposed to drive with headphones on. From what I remember of drivers education it was because you need to be able to hear emergency vehicles.

I did not know this myself but i would not think it is unreasonable for it to be a law. but the fact that so many people here are giving to such a hard time seems a little unfair. Its not like anyone here is a perfect driver or has done everything by the book. So i would sweeten up your criticism before damning someone.  i think it was a bit unsafe but nothing half as worse as textin or talking on the phone while driving. Come on I have seen people do thing far worse in my time of driving then using headphones. 
 
All i would say is you live and you learn, the police have many laws they can enforce some are needed others are to be a dick. So you learn what you should and should not do by your actions and i agree 55 bucks is a light slap on the wrist and sure the cop could have been nicer but i would say your still pretty lucky. I think a no seat belt fine is around 100 bucks now so i think 55 is not too bad.

Depends on if they're open or closed earphones.  Also the noise canceling.
 
I always use open earphones because I don't like not being able to hear my surroundings.  It's no worse than using a stereo or other speakers.  If I got a fine for using them I'd be pissed.

This is true. If your stereo doesn't have an auxiliary input, then you should get an inline FM modulator. I have this one and it works really well. They're really easy to install if you have a spare cigarette lighter and are familiar with stereo installation. If you're not comfortable with that, though, you can get good FM modulators for decent prices at truck stops (e.g. Flying J). I'd avoid the cheap crap at Walmart or Target because their transmission range and strength are pretty poor. The ones at truck stops seem to be higher quality for some reason. While on a family trip with my wife (in the car that doesn't have the inline modulator), we picked up a regular modulator at a truck stop for $20. It was powerful enough that we never had to change the frequency, even while driving through Las Vegas and San Diego, and it included a USB port for charging your MP3 player. Anyway, OP, wearing your headphones while driving is dumb. You're less able or unable to hear emergency vehicle sirens and other important ambient noises. That's why it's illegal.

From what I understand its so that you don't have loss of awareness which would constitute a public hazard.  Also the aforementioned you need to hear Police or ambulance sirens and pull over.
 
More than likely though, the Cop was just trying to make an example and scare you into not doing it again.

A) Texting while driving is statistically as bad or worse (I can't remember off the top of my head, I had to attend some seminar on this) than drunk driving. B) Other cars don't have the magic stopping device, when they're hitting you.   Anyway, you can actually listen to an iPod with one earbud in. Little known fact. "

That's kind of stupid for wearing your headphones while driving.  You need to be able to hear sirens and such.

You are seriously going to criticize Kyreo for using headphones while driving, when you both text and use a labtop while driving?! Not only are you doing that, but you are talking like everyone in the world has an expensive car like you. You clearly live inside a bubble my friend, i would rather have someone driving with headphones, then having some fool who is typing a paper or texting and thinks his car will be able to save his ass in any situation.

I've been driving for years, and I understand how city traffic works.  I don't do it everyday, and only text when it's really important about meeting up and whatnot, so no one gets lost and crap.  Also, many cars now of all ranges of prices have the assisted driver abilities, as many Fords and Toyota's do it too.  It's only supposed to work for city driving when it's really busy because they know the drivers won't be as focused when they're stuck on a light for minutes on end.   
 
Trust me, I take safety very seriously.

Thinking it's okay to drive with headphones shows you haven't been driving for very long.  
 
I've been driving for 10 years now, and I clearly understand that headphones are much better at canceling out noise than the car stereo.  Your ears are enclosed in the headphones, but they aren't when the car stereo is being used.  Although a loud car stereo isn't the best for driving either, the chances you'll hear the firetruck or anything else is better than the chances you'd hear it with headphones. 
 
That's why it's dangerous to use headphones.  I wouldn't want to be anywhere near a person who uses headphones while driving.  My life would be in danger.

You're driving. When you have headphones, not only is it harder to focus on driving, but you can't hear anything around you. You know, if a car honks or something? You shouldn't be wearing headphones for any reason. You're putting yourself and other drivers at risk. Just accept the fine.

When i drive with headphones i can hear cars horns and sirens easily. Theres a reason sirens are so loud so that even if your windows are all the way up and youve got the music blaring, or you have headphones on you can still hear them.

I didn't know this was an offense, but I find it funny that people think it's not a big deal and think it's no worse than listening to your stereo turned up. Ear phones are like ear plugs,except what they lack in blocking noise they make up for by pumping music into into your ears.

@KaosAngel: I did a nice internship at a hospital in New York, and did some tours riding along in an ambulance. The amount of accidents caused by people texting in the car was pretty high, you can't say you take safety seriously if you're on laptop and texting while driving. Of course you can think you take safety seriously when you haven't had a serious accident yet, but on the off-chance that an accident occurs and you possibly ruin or end someone's life you will be eating those words. I think it's pretty obvious even from personal driving experience that people texting while driving are very distracted and become hazards on the road. Also, don't use the safety features of your car as an excuse for poor driving, they're meant to add another layer of safety to avoiding collisions, not as a crutch for you to drive distracted and have them activate and save your ass.

If it is legal for people who can't hear to drive, why do others have to be able to hear to drive? I don't drive with headphones, but the safety of headphones is irrelevant. It doesn't change the fact it is an inconsistency with the law which is total bullshit.

It was a fair point to set why retort to name calling? I just don't understand the method of trying to be rude and thinking it make your point any better.

Deaf people can't hear; they're deaf.
 
 
Obviously someone who is blind shouldn't be driving, and the same holds true for someone wearing a blindfold because they have the same symptoms of blindness (not being able to see). So, if it's completely legal for a deaf person to drive, why is it not okay for someone who has the symptoms of a deaf person (not being able to hear their surroundings) to drive?

If you were blind and crossed the road, and caused a car accident, you would not be charged because you did not choose to be blind.

Well... I live on a Military Base and the safety regulations are strict as fuck.  All bikers MUST wear a Helmet, Joggers MUST wear reflective clothing or vests, music volumes are regulated based upon how clearly someone can hear you at a certain distance...   I can't imagine there are bullshit regulations like this in the civilian world. "
It's illegal in all of California. I'm not sure if it's the same with other states, but it is indeed against the law. I can see why it's against the law, but it still sucks. Next time, I suggest either not wearing your headphones while driving, or only wear them at night when no one will notice them.

I'm going to disagree with the majority, and say that this is a load of crap. It's certainly not against the law here to drive with headphones in your ears, and I don't see why it should be. I've been driving for about 10 years now, and I have never run into any problems because I was wearing headphones. But maybe that's because I actually pay attention to the road; you know, do more than just look straight ahead.  
  
Oh, and in case anyone is wondering: I wear in-ear headphones, and I still hear sirens and shit just fine.

Be glad you only got a $55 fine and didn't instead hit another car or something due to not having your full attention on the road and end up spending a lot more for repairs, insurance, lawsuits etc. If you're listening to the podcast, it's not like music where there's just sort of a groove and you don't need to pay much attention to get anything out of it, and if you're not really paying attention to the podcast itself, then why listen at all? Simply put, don't be a fucking asshole and listen to headphones while driving.

Hmm. I'm unsure about this one. At first I thought maybe he thought you were using one of those wireless thingies for when you're on the phone, but I actually think they are legal. And if they are legal, and in my opinion much more distracting than listening to a radio station on your headphones, I don't understand why you'd be pulled over. Plus people listen to music way too loud all the time so being told it's because you can't hear is a bit odd. Also, I'm pretty sure deaf people are allowed to drive. So the whole not hearing people screaming thing is a bit hmm!
