The definition of used from dictionary.com doesn't really make it sound like transferring a game from the case to a sleeve makes it used. Sure, if the game had a smudge, then you could have demanded to have a "shopworn discount" be applied to the disc, but you didn't. It was probably nothing more than a fingerprint on the bottom of a disc, which happens pretty damn easily. "

Bottom line there is no reason to open up a copy of a game just because they want to put the case on display!!!!  And lets face it when the employee took it out of that case who's to say that employee never put it in a 360 to give it a try??? GameStop doesn't deserve to advertise the product they're selling on the floor for customers to see? If you don't want to buy a potentially gutted game, then go to WalMart or Best Buy. I don't really care what the cover or disc looks like as long as it works (unless it's that generic case crap).  Oh, and you can say fuck here. "

It's not the only way to display a game, but when all they have are copies of the game, they're going to put them out to display. Best Buy does the exact same thing, except they're locked inside these boxes. WalMart has display cases that are locked. GameStop has shelves. If they throw a case out with the game in it in a retail store, it'll get stolen in a heart beat.
